13         Amendment (with title amendment) 

14  Remove everything after the enacting clause

16  and insert:

17         Section 1.  Section 256.15, Florida Statutes, is

18  created to read:

19         256.15  Display of U.S. flag; prohibition unlawful;

20  penalty.--

21         (1)  It is unlawful for any person to prohibit:

22         (a)  The display of the flag of the United States, or

23         (b)  The display of the flag of the United States by

24  means of a portable, removable flag pole.

26  This section shall not apply when the display of the flag of

27  the United States would constitute a threat to the health or

28  safety of any person or would interfere with the operation of

29  a business or educational institution.

30         (2)  A violation of this section constitutes a

31  noncriminal violation. The first violation shall be punished

  1  by fine in an amount not to exceed $500. A second or

  2  subsequent violation shall be punished by fine in an amount

  3  not to exceed $10,000.

  4         Section 2.  This act applies retroactively regardless

  5  of any declaration rules or requirements of homeowners'

  6  association dealing with flags or decorations.
