17         Section 1.  Section 256.15, Florida Statutes, is
18  created to read:
19         256.15  Display of U.S. flag; prohibition unlawful;
20  penalty.--
21         (1)  It is unlawful for any person to prohibit:
22         (a)  The display of a portable, removable flag of the
23  United States on one's own real or personal property that is
24  no larger than 3 feet by 5 feet, or
25         (b)  The display of the flag of the United States on
26  one's own real or personal property that is less than 3 feet
27  by 5 feet by means of a portable, removable flag pole that is
28  no higher than 15 feet and no greater than 6 inches in
29  diameter.

31  This section shall not apply if the display of the flag of the

HOUSE AMENDMENT Bill No. CS for CS for SB 150, 1st Eng. Amendment No. ___ (for drafter's use only) 1 United States constitutes a threat to the health, safety or 2 welfare of any person or interferes with the operation of a 3 business, religious, or educational institution or if such 4 display violates a municipal or county ordinance. 5 (2) A violation of this section constitutes a 6 noncriminal violation. The first violation shall be punished 7 by fine in an amount not to exceed $500. A second or 8 subsequent violation shall be punished by fine in an amount 9 not to exceed $10,000. 10 Section 2.
