2 An act relating to community college funding;
3 amending s. 240.359, F.S.; revising the method
4 of determining the annual apportionment to each
5 community college from state funds; providing
6 an effective date.

8 Be It Enacted by the Legislature of the State of Florida:
9
10 Section 1. Subsection (3) of section 240.359, Florida
11 Statutes, is amended to read:
12 240.359 Procedure for determining state financial
13 support and annual apportionment of state funds to each
14 community college district.--The procedure for determining
15 state financial support and the annual apportionment to each
16 community college district authorized to operate a community
17 college under the provisions of s. 240.313 shall be as
18 follows:
19 (3) DETERMINING THE APPORTIONMENT FROM STATE FUNDS.--
20 (a) By December 15 of each year, the Department of
21 Education shall estimate the annual enrollment of each
22 community college for the current fiscal year and for the 6
23 subsequent fiscal years. These estimates shall be based upon
24 prior years' enrollments, upon the initial fall term
25 enrollments for the current fiscal year for each college, and
26 upon each college's estimated current enrollment and
27 demographic changes in the respective community college
28 districts.
29 (a)(b) The apportionment to each community college
30 from the Community College Program Fund shall be determined
31 annually in the General Appropriations Act. In determining

1 each college's apportionment, the Legislature shall consider
2 the following components:
3 1. Base budget, which includes the state general
4 revenue and lottery appropriations appropriation to the
5 Community College Program Fund in the current year plus the
6 related student matriculation and tuition fees established
7 assigned in the current General Appropriations Act.
8 2. The cost-to-continue allocation, which consists of
9 incremental changes to the base budget, including salaries,
10 price levels, and other related costs allocated through the
11 operational resources funding model approved by the Florida
12 Board of Education which will include, but not be limited to:
13 a. Direct Instructional Funding, including class size,
14 faculty productivity factors, average faculty salary, ratio of
15 full-time to part-time faculty, costs of programs, and
16 enrollment factors;
17 b. Academic Support, including small colleges factor,
18 multi-campus factor, and enrollment factor;
19 c. Student Services Support, including headcount of
20 students as well as FTE count and enrollment factors;
21 d. Library Support, including volume and other
22 materials/audio visual requirements;
23 e. Special Projects;
24 f. Operations and Maintenance of Plant, including
25 square footage and utilization factors; and
26 g. District Cost Differential.
27 3. Enrollment workload adjustment, which shall be
28 determined as follows:
29 a. The actual full-time equivalent enrollment for the
30 prior year, as accepted or modified by the Legislature, shall
31 be the assigned enrollment and the basis for allocating

1 appropriated funds for enrollment workload. If the enrollment
2 workload allocation to a college is determined to be less than
3 zero, the reduction in allocation shall be implemented over a
4 2-year period.
5 b. The systemwide average direct instructional cost
6 level of each program of study shall be used to calculate the
7 enrollment workload adjustment. This amount, multiplied by a
8 factor of 1.3, for support services shall be multiplied by the
9 change in enrollment as determined in sub-subparagraph a.
10 From this amount, student matriculation and tuition fees
11 generated by the change in assigned enrollment shall be
12 deducted and the remaining amount shall be the state
13 allocation to each college for enrollment workload.
14 c. Students enrolled in a recreation and leisure
15 program and students enrolled in a lifelong learning program
16 may not be counted as full-time equivalent enrollments for
17 purposes of enrollment workload adjustments.
18 3.4. Operating costs of new facilities adjustments,
19 which shall be provided, from funds available, for each new
20 facility that is owned by the college and is recommended in
21 accordance with s. 235.15.
22 4.5. New and improved program enhancements, which
23 shall be determined by the Legislature and may be allocated
24 through the operational resources funding model approved by
25 the Florida Board of Community Colleges.
26 5. Performance-based-budget funding.
27 6. Workforce development funding.
28 (b) The sum of general revenue and lottery
29 appropriations shall be disbursed monthly in 12 equal
30 payments. If lottery funds are insufficient to make equal
31 monthly disbursements, the shortfall shall be eliminated

1 through an increase in monthly general revenue disbursements,
2 but such disbursements are limited to the total of the general
3 revenue appropriation.

5 Student fees in the base budget plus student fee revenues
6 generated by increases in fee rates shall be deducted from the
7 sum of the components determined in subparagraphs 1.-5. The
8 amount remaining shall be the net annual state apportionment
9 to each college.
10 (c) No community college shall commit funds for the
11 employment of personnel or resources in excess of those
12 required to continue the same level of support for either the
13 previously approved enrollment or the revised enrollment,
14 whichever is lower.
15 (c)(d) The apportionment to each community college
16 district for capital outlay and debt service shall be the
17 amount determined in accordance with subsection (2). This
18 amount, less any amount determined as necessary for
19 administrative expense by the Florida State Board of Education
20 and any amount necessary for debt service on bonds issued by
21 the State Board of Education, shall be transmitted to the
22 community college district board of trustees to be expended in
23 a manner prescribed by rules of the Florida State Board of
24 Education.
25 (e) Colleges shall seek to maintain an unencumbered
26 fund balance of between 4 percent and 10 percent of the funds
27 available in the current general fund of the operating budget.
28 If the 10-percent upper level is exceeded for 2 consecutive
29 years, the appropriation to the college in a succeeding fiscal
30 year shall be reduced by the average of the excess of the fund
31 balance over the 10 percent for the 2 years. In exceptional

1 cases, when fund balances greater than 10 percent are
2 necessary for a college, prior approval shall be obtained from
3 the State Board of Community Colleges.
4 (d)(f) Expenditures for apprenticeship programs shall
5 be reported separately.
6 Section 2. This act shall take effect July 1, 2002.
