17         Section 1.  Paragraph (i) of subsection (24) of section

18  380.06, Florida Statutes, is added to read:

19         380.06  Developments of regional impact.--

20         (24)  STATUTORY EXEMPTIONS.--

21         (i)1.  Any proposal to increase development at a

22  waterport or marina existing on the effective date of this act

23  or any new waterport or marina development is exempt from the

24  provisions of this section, unless located within a county

25  identified in s. 370.12(2)(f).

26         2.  Any waterport or marina development located within

27  a county identified in s. 370.12(2)(f) shall be exempt from

28  the provisions of this section when such county has adopted

29  marina siting policies into the coastal management or land use

30  element of its comprehensive plan.  Such policies must be

31  transmitted by December 31, 2003, and must be adopted prior to

  1  or within 1 year after the transmittal of the policies to the

  2  state land planning agency.  If no such policies are adopted

  3  into the comprehensive plan by December 31, 2004, then any

  4  increase or new development in such county shall be exempt

  5  from the provisions of this section.  The adoption of marina

  6  siting policies into the comprehensive plan is exempt from s.

  7  163.3187(1).  Any subsequent change to a marina siting policy

  8  shall  be treated as a small-scale amendment as defined in s.

  9  163.3187(1)(c).  Prior to the adoption of marina siting

10  policies or December 31, 2004, the current standards and

11  thresholds provided for in ss. 380.06(19)(b)8. and

12  380.0651(3)(e) are applicable.
