  1                      A bill to be entitled

  2         An act relating to sales of tax deeds; creating

  3         s. 197.574, F.S.; authorizing a county to

  4         impose certain deed restrictions on the tax

  5         sale of certain property for certain purposes;

  6         requiring notice; providing for notice content;

  7         requiring reading of such restrictions at

  8         public auction; requiring such restrictions to

  9         be placed upon the face of the deed upon sale;

10         providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Section 197.574, Florida Statutes, is

15  created to read:

16         197.574  Restrictions imposed at tax sale.--

17         (1)  A county making an application for tax deed,

18  pursuant to s. 197.502(3), for property to be sold that is

19  classified as nonagricultural acreage or vacant land for

20  assessment purposes, according to use classifications

21  established by the department, may impose at the time of sale

22  deed restrictions upon the title to the property that have the

23  effect of having the property conform to the current approved

24  local government comprehensive plan of the county.

25         (2)  A county that elects to impose restrictions

26  pursuant to subsection (1) shall provide notice of its intent

27  to impose such restrictions by including the text of the

28  restrictions in the notice required under s. 197.512.

29         (3)  During the sale at public auction, provided in s.

30  197.542, of property with restrictions imposed pursuant to

31  subsection (1) and prior to the auction of any particular

  1  restricted property, the clerk of the circuit court, or his or

  2  her deputy, of the county in which the property is located

  3  shall announce and read the restrictions at public outcry.

  4  Upon sale of such property, the clerk shall place the text of

  5  the restrictions upon the face of any tax deed issued for such

  6  property pursuant to s. 197.522.

  7         Section 2.  This act shall take effect upon becoming a

  8  law.
