  1                      A bill to be entitled

  2         An act relating to trust funds; creating s.

  3         570.209, F.S.; creating the Rural Lands Program

  4         Trust Fund within the Department of Agriculture

  5         and Consumer Services; providing for sources of

  6         funds and purposes; providing for annual

  7         carryforward of funds; providing for future

  8         review and termination or re-creation of the

  9         trust fund; providing a contingent effective

10         date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Section 570.209, Florida Statutes, is

15  created to read:

16         570.209  Rural Lands Program Trust Fund of the

17  Department of Agriculture and Consumer Services.--

18         (1)  There is created a Rural Lands Program Trust Fund

19  within the Department of Agriculture and Consumer Services.

20  The purpose of the trust fund is to receive funds pursuant to

21  s. 201.15(1)(c) to pay debt service on bonds issued pursuant

22  to s. 215.619.

23         (2)  Notwithstanding the provisions of s. 216.301 and

24  pursuant to s. 216.351, any balance in the trust fund at the

25  end of any fiscal year shall remain in the trust fund at the

26  end of the year and shall be available for carrying out the

27  purposes of the trust fund.

28         (3)  Pursuant to the provisions of s. 19(f)(2), Art.

29  III of the State Constitution, the trust fund shall, unless

30  terminated sooner, be terminated on July 1, 2006. Prior to its

  1  scheduled termination, the trust fund shall be reviewed as

  2  provided in s. 215.3206(1) and (2).

  3         Section 2.  This act shall take effect July 1, 2002, if

  4  Committee Substitute for Senate Bill 1770 or similar

  5  legislation is adopted in the same legislative session or an

  6  extension thereof and becomes law.

11  The committee substitute will take effect only if CS/SB 1770
    or similar legislation is enacted during the same legislative
12  session.
