11  Senator Holzendorf moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 1, between lines 24 and 25,

16  insert:

17         (3)  Notwithstanding subsections (1) and (2), in the

18  event that a customer is unable to pay a judgment for damages

19  resulting from the customer's negligent operation of a powered

20  shopping cart on the premises of the owner of the powered

21  shopping cart, the owner of the powered shopping cart shall be

22  liable for the judgment in an amount not to exceed the cost of

23  medical treatment for the injured party.
