11  Senator Geller moved the following amendment:

13         Senate Amendment (with title amendment) 

14         Delete everything after the enacting clause

15

16  and insert:

17         Section 1.  Subsections (4) and (5) are added to

18  section 316.0741, Florida Statutes, to read:

19         316.0741  High occupancy vehicle lanes.--

20         (4)  Notwithstanding any other provision of this

21  section, an inherently low-emission vehicle (ILEV) that is

22  certified and labeled in accordance with federal regulations

23  may be driven in an HOV lane at any time, regardless of its

24  occupancy. The department shall issue a decal and registration

25  certificate, to be renewed annually, reflecting the HOV lane

26  designation on inherently low-emission vehicles authorizing

27  such use. The department may charge a fee for the decals, at a

28  price not to exceed the costs of designing, producing, and

29  distributing each decal, or $5, whichever is less. The

30  proceeds from sale of the decals shall be deposited in the

31  Highway Safety Operating Trust Fund.

  1         (5)  The department has specific authority to adopt

  2  rules addressing the design, production, and distribution of

  3  the decals described in subsection (4); the enforcement of

  4  ILEV use of HOV lanes; and the purchase and renewal of such

  5  decals.

  6         Section 2.  This act shall take effect October 1, 2002.

15         An act relating to high occupancy vehicle

16         lanes; amending s. 316.0741, F.S.; allowing

17         certain energy-saving vehicles to travel in

18         such lanes, regardless of occupancy; providing

19         for a decal and registration certificate;

20         providing for a fee; providing rulemaking

21         authority; providing an effective date.
