12  following amendment to Senate Amendment (144778) to House
13  Amendment (154855):

16         On page 122, between lines 16 & 17,

18  insert:  
19         (k)1.  Any waterport or marina development is exempt
20  from the provisions of this section if the relevant county or
21  municipality has adopted a boating facility siting plan or
22  policy which includes applicable criteria, considering such
23  factors as natural resources, manatee protection needs and
24  recreation and economic demands as generally outlined in the
25  Bureau of Protected Species Management Boat Facility Siting
26  Guide, dated August 2000, into the coastal management or land
27  use element of its comprehensive plan. The adoption of boating
28  facility siting plans or policies into the comprehensive plan
29  is exempt from the provisions of s. 163.3187(1). Any waterport
30  or marina development within the municipalities or counties
31  with boating facility siting plans or policies adopted prior

 1  to April 1, 2002 are exempt from the provisions of this
 2  section, when their boating facility siting plan or policy is
 3  adopted as part of the relevant local government's
 4  comprehensive plan.
 5         2.  Within six months of the effective date of this
 6  law, the Department of Community Affairs, in conjunction with
 7  the Department of Environmental Protection and the Florida
 8  Fish and Wildlife Conservation Commission, shall provide
 9  technical assistance and guidelines, including model plans,
10  policies and criteria to local governments for the development
11  of their siting plans.
