13         Amendment (with title amendment) 

14         On page 52, between lines 27 and 28,

16  insert:

17         Section 14.  Subsections (1) and (2) of section

18  287.0595, Florida Statutes, are amended to read:

19         287.0595  Pollution response action contracts;

20  department rules.--

21         (1)  The Department of Environmental Protection shall

22  establish, through the promulgation of administrative rules as

23  provided in chapter 120:

24         (a)  Procedures for determining the qualifications of

25  responsible potential vendors bidders prior to advertisement

26  for and receipt of bids, proposals, or replies for pollution

27  response action contracts, including procedures for the

28  rejection of unqualified vendors bidders. Response actions are

29  those activities described in s. 376.301(37).

30         (b)  Procedures for awarding such contracts to the

31  lowest responsible and responsive vendor qualified bidder as

  1  well as procedures to be followed in cases in which the

  2  department declares a valid emergency to exist which would

  3  necessitate the waiver of the rules governing the awarding of

  4  such contracts to the lowest responsible and responsive vendor

  5  qualified bidder.

  6         (c)  Procedures governing payment of contracts.

  7         (d)  Procedures to govern negotiations for contracts,

  8  modifications to contract documents, and terms and conditions

  9  of contracts.

10         (2)  In adopting rules under this section, the

11  Department of Environmental Protection shall follow the

12  criteria applicable to the department's Department of

13  Management Services contracting to the maximum extent

14  possible, consistent with the goals and purposes of ss.

15  376.307 and 376.3071.
