  2         An act relating to telecommunications

  3         companies; amending s. 364.02, F.S.; defining

  4         the term "inter-exchange carrier"; providing

  5         for continued tax and fee liability; providing

  6         an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Present subsections (6) through (13) of

11  section 364.02, Florida Statutes, are redesignated as

12  subsections (7) through (14), respectively, and new subsection

13  (6) is added to that section, to read:

14         364.02  Definitions.--As used in this chapter:

15         (6)  "Inter-exchange carrier" means a company, other

16  than a local exchange telecommunications company, owning

17  facilities in the state which consist of network elements and

18  switches or consists of other communication transmission

19  equipment used to carry voice, data, image, and video traffic

20  between local calling areas. However, each inter-exchange

21  carrier will continue to be liable for any taxes imposed

22  pursuant to chapters 203 and 212 and any fees that are

23  assessed pursuant to s. 364.025 and are subject to ss. 364.04

24  and 364.501.

25         Section 2.  This act shall take effect upon becoming a

26  law.
