  1                      A bill to be entitled

  2         An act relating to Escambia County; amending s.

  3         1, ch. 57-1291, Laws of Florida; providing an

  4         exception for stormwater management facilities

  5         to a requirement of enclosures around certain

  6         depressions; providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Section 1 of chapter 57-1291, Laws of

11  Florida, is amended to read:

12         Section 1.  In the interest of public safety, it shall

13  be the duty of the owner, lessor, or occupant of any real

14  property within the limits of Escambia county, wherein there

15  exists any clay pits, caves or other depression so located and

16  of such depth that a child might conceivably be drowned

17  therein when filled with rain water or other liquid, to

18  enclose the depression with a fence or other device of a

19  height of four (4) feet or more. The enclosure shall be of

20  such construction as not to be penetrable without the aid of

21  tools or other mechanical device. This section does not apply

22  to a stormwater management facility within the City of

23  Pensacola which is constructed in accordance with uniform

24  state rules adopted pursuant to section 120.54, Florida

25  Statutes, or with more-restrictive ordinances adopted by local

26  government.

27         Section 2.  This act shall take effect upon becoming a

28  law.
