  1                      A bill to be entitled

  2         An act relating to sewage treatment systems;

  3         amending s. 381.0066, F.S.; eliminating a

  4         durational limitation on an additional fee for

  5         new system construction permits; providing an

  6         effective date.

  7

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Subsection (2) of section 381.0066, Florida

11  Statutes, is amended to read:

12         381.0066  Onsite sewage treatment and disposal systems;

13  fees.--

14         (2)  The minimum fees in the following fee schedule

15  apply until changed by rule by the department within the

16  following limits:

17         (a)  Application review, permit issuance, or system

18  inspection, including repair of a subsurface, mound, filled,

19  or other alternative system or permitting of an abandoned

20  system:  a fee of not less than $25, or more than $125.

21         (b)  Site evaluation, site reevaluation, evaluation of

22  a system previously in use, or a per annum septage disposal

23  site evaluation:  a fee of not less than $40, or more than

24  $115.

25         (c)  Biennial Operating permit for aerobic treatment

26  units or performance-based treatment systems: a fee of not

27  more than $100.

28         (d)  Annual operating permit for systems located in

29  areas zoned for industrial manufacturing or equivalent uses or

30  where the system is expected to receive wastewater which is

  1  not domestic in nature:  a fee of not less than $150, or more

  2  than $300.

  3         (e)  Innovative technology:  a fee not to exceed

  4  $25,000.

  5         (f)  Septage disposal service, septage stabilization

  6  facility, portable or temporary toilet service, tank

  7  manufacturer inspection:  a fee of not less than $25, or more

  8  than $200, per year.

  9         (g)  Application for variance:  a fee of not less than

10  $150, or more than $300.

11         (h)  Annual operating permit for waterless,

12  incinerating, or organic waste composting toilets:  a fee of

13  not less than $50, or more than $150.

14         (i)  Aerobic treatment unit or performance-based

15  treatment system maintenance entity permit: a fee of not less

16  than $25, or more than $150, per year.

17         (j)  Reinspection fee per visit for site inspection

18  after system construction approval or for noncompliant system

19  installation per site visit: a fee of not less than $25, or

20  more than $100.

21         (k)  Research:  An additional $5 fee shall be added to

22  each new system construction permit issued during fiscal years

23  1996-2002 to be used for onsite sewage treatment and disposal

24  system research, demonstration, and training projects. Five

25  dollars from any repair permit fee collected under this

26  section shall be used for funding the hands-on training

27  centers described in s. 381.0065(3)(j).

28         (l)  Annual operating permit, including annual

29  inspection and any required sampling and laboratory analysis

30  of effluent, for an engineer-designed performance-based

31  system:  a fee of not less than $150, or more than $300.

  2  The funds collected pursuant to this subsection must be

  3  deposited in a trust fund administered by the department, to

  4  be used for the purposes stated in this section and ss.

  5  381.0065 and 381.00655.

  6         Section 2.  This act shall take effect upon becoming a

  7  law.
