  1                      A bill to be entitled

  2         An act relating to school suspension or

  3         expulsion; amending s. 230.235, F.S.; providing

  4         that a student may be released from the school

  5         campus following an offense that subjects the

  6         student to suspension or expulsion; requiring

  7         that the student be released to the custody of

  8         a parent or legal guardian; requiring that a

  9         student who has committed a violent act be

10         released to the custody of a law enforcement

11         agency; providing an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14

15         Section 1.  Subsection (4) is added to section 230.235,

16  Florida Statutes, to read:

17         230.235  Policy of zero tolerance for crime and

18  victimization.--

19         (4)  If a student commits an offense that subjects the

20  student to suspension or expulsion, the school principal may

21  immediately release the student from the school campus, but

22  only if the student is released to the custody of a parent or

23  legal guardian. Otherwise, the student must be placed in

24  in-school suspension or detention until the end of the school

25  day. If the student has committed a violent act, the student

26  shall be released to the custody of a law enforcement agency.

27         Section 2.  This act shall take effect July 1, 2002.

  3    Provides for a student to be released to the custody of a

  4    offense that subjects the student to suspension or
      expulsion. If the student cannot be released to a parent
  5    or guardian, requires that the student be placed in
      in-school suspension or detention until the end of the
  6    school day. Requires that the student be released to the
      custody of a law enforcement agency if the student has
  7    committed a violent act.
