14 On page 30, between lines 20 and 21,

16 and insert:
17 Section 22. Subsection (7) of section 322.095, Florida
18 Statutes, is amended and subsection (8) is added to that
19 section, to read:
20 322.095 Traffic law and substance abuse education
21 program for driver's license applicants.--
22 (7)(a) No governmental entity or court shall provide,
23 issue, or maintain any information or orders regarding traffic
24 law and substance abuse education program schools or course
25 providers, with the exception of directing inquiries or
26 requests to the local telephone directory heading of driving
27 instruction or the driver's license applicant reference guide.
28 However, The department is authorized to maintain the
29 information and records necessary to administer its duties and
30 responsibilities for the program. Where such information is a
31 public record as defined in chapter 119, it shall be made

1 available to the public upon request pursuant to s. 119.07(1).
2 (b) The department shall prepare for any governmental
3 entity to distribute a driver's license applicant reference
4 guide which shall list the benefits of attending a traffic law
5 and substance abuse education school, but under no
6 circumstance may include any list of course providers or
7 schools. The department shall refer further inquiries to the
8 telephone directory heading of driving instruction.
9 (8)(a) The department shall regulate course providers
10 that use technology to deliver traffic-law and substance-abuse
11 education courses authorized by this section.
12 (b) Courses submitted to the department for approval
13 on or after May 1, 2002, must have received approval for
14 statewide delivery and must include independent scientific
15 research evidence of their effectiveness.
