  1                      A bill to be entitled

  2         An act relating to the Florida Retirement

  3         System; amending ss. 121.021 and 121.0515,

  4         F.S.; including certain members employed as

  5         Federal Aviation Administration-licensed pilots

  6         authorized to provide mosquito control services

  7         in the special risk class; providing

  8         exceptions; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Paragraph (f) is added to subsection (15)

13  of section 121.021, Florida Statutes, to read:

14         121.021  Definitions.--The following words and phrases

15  as used in this chapter have the respective meanings set forth

16  unless a different meaning is plainly required by the context:

18         (f)  Effective July 1, 2002, the term "special risk

19  member" includes any member employed as a Federal Aviation

20  Administration-licensed pilot by a municipality, county,

21  special district, or state agency authorized to provide

22  mosquito control services whose duties include piloting for

23  the purpose of mosquito control treatment as set forth in s.

24  121.0515(2)(h).

25         Section 2.  Subsection (1) of section 121.0515, Florida

26  Statutes, is amended, and paragraph (h) is added to subsection

27  (2) of said section, to read:

28         121.0515  Special risk membership.--

29         (1)  LEGISLATIVE INTENT.--In creating the Special Risk

30  Class of membership within the Florida Retirement System, it

31  is the intent and purpose of the Legislature to recognize that

  1  persons employed in certain categories of law enforcement,

  2  firefighting, criminal detention, aviation, and emergency

  3  medical care positions are required as one of the essential

  4  functions of their positions to perform work that is

  5  physically demanding or arduous, or work that requires

  6  extraordinary agility and mental acuity, and that such

  7  persons, because of diminishing physical and mental faculties,

  8  may find that they are not able, without risk to the health

  9  and safety of themselves, the public, or their coworkers, to

10  continue performing such duties and thus enjoy the full career

11  and retirement benefits enjoyed by persons employed in other

12  positions and that, if they find it necessary, due to the

13  physical and mental limitations of their age, to retire at an

14  earlier age and usually with less service, they will suffer an

15  economic deprivation therefrom. Therefore, as a means of

16  recognizing the peculiar and special problems of this class of

17  employees, it is the intent and purpose of the Legislature to

18  establish a class of retirement membership that awards more

19  retirement credit per year of service than that awarded to

20  other employees; however, nothing contained herein shall

21  require ineligibility for special risk membership upon

22  reaching age 55.

23         (2)  CRITERIA.--A member, to be designated as a special

24  risk member, must meet the following criteria:

25         (h)  The member must be employed as a Federal Aviation

26  Administration-licensed pilot by a municipality, county,

27  special district, or state agency authorized to provide

28  mosquito control services. The member's duties must include

29  piloting aircraft for the purpose of mosquito control

30  treatment. However, administrative support personnel,

31  including, but not limited to, those whose primary

  1  responsibilities are in accounting, purchasing, legal, and

  2  personnel, shall not be included.

  3         Section 3.  This act shall take effect July 1, 2002.
