  2         An act relating to chronic diseases; creating

  3         s. 385.210, F.S.; creating the "Arthritis

  4         Prevention and Education Act"; providing

  5         legislative findings; providing purposes;

  6         directing the Department of Health to establish

  7         an arthritis prevention and education program;

  8         requiring the department to conduct a needs

  9         assessment; providing for establishment of an

10         advisory panel on arthritis; providing for

11         implementation of a public awareness effort;

12         providing for funding through contributions;

13         directing the Secretary of Health to seek

14         federal waivers as necessary to maximize

15         federal funding; establishing a Prostate Cancer

16         Awareness Program within the Department of

17         Health; specifying purpose, activities,

18         administration, and funding sources for the

19         program; creating a prostate cancer advisory

20         committee; providing for appointment of

21         members; providing for reimbursement of

22         expenses; providing an effective date.

24         WHEREAS, prostate cancer is the most common type of

25  cancer and the second leading cause of death from cancer among

26  men in the United States and in Florida, and

27         WHEREAS, an estimated 198,100 men in the United States

28  will have been diagnosed with prostate cancer in 2001, 15,000

29  of them residents of Florida, and

  1         WHEREAS, an estimated 31,500 men in the United States

  2  will have died from prostate cancer in 2001, 2,400 of them

  3  residents of Florida, and

  4         WHEREAS, Florida has both the second highest number of

  5  new cases of prostate cancer and the second highest number of

  6  deaths from prostate cancer in the United States, and

  7         WHEREAS, the risk of being diagnosed with prostate

  8  cancer is higher among elderly men, and Florida has a high

  9  percentage of elderly men compared to other states, and

10         WHEREAS, African-American men have a 50-percent higher

11  risk of being diagnosed with prostate cancer and are more than

12  twice as likely to die from the disease than Caucasian men,

13  but are less likely to be screened for the disease, and

14         WHEREAS, 74 percent of all prostate cancer among

15  African-American men is detected at local and regional sites;

16  however, the 5-year survival rate drops to 30 percent when

17  prostate cancer has spread to distant sites, and

18         WHEREAS, the risk of being diagnosed with prostate

19  cancer is 50 percent higher among men with a family history of

20  prostate cancer, and

21         WHEREAS, the 5-year survival rate for men who have

22  prostate cancer diagnosed at an early stage is 95 percent

23  compared to 34 percent when diagnosis occurs at a late stage,

24  and 68 percent of non-Caucasian men with prostate cancer in

25  Florida are diagnosed at an early stage compared to 75 percent

26  of Caucasian men, NOW, THEREFORE,

27

28  Be It Enacted by the Legislature of the State of Florida:

29

30         Section 1.  Section 385.210, Florida Statutes, is

31  created to read:

  1         385.210 Arthritis prevention and education.--

  2         (1)  SHORT TITLE.--This act may be cited as the

  3  "Arthritis Prevention and Education Act."

  4         (2)  LEGISLATIVE FINDINGS.--The Legislature finds the

  5  following:

  6         (a)  Arthritis encompasses more than 100 diseases and

  7  conditions that affect joints, the surrounding tissues, and

  8  other connective tissues.

  9         (b)  Arthritis is the leading cause of disability in

10  the United States, limiting daily activities for more than 7

11  million citizens.

12         (c)  This disease has a significant impact on quality

13  of life, not only for the individual who experiences its

14  painful symptoms and resulting disability, but also for family

15  members and caregivers.

16         (d)  There are enormous economic and social costs

17  associated with treating arthritis and its complications,

18  which are estimated at almost $80 billion annually in the

19  United States.

20         (e)  Currently, the challenge exists to ensure delivery

21  of effective, but often underutilized, interventions that are

22  necessary in the prevention or reduction of arthritis-related

23  pain and disability.

24         (f)  Although there exists a large quantity of public

25  information about arthritis, including programs that can

26  dramatically impact early diagnosis and treatment as well as

27  the quality of life of people with arthritis, such information

28  remains inadequately disseminated and insufficient in

29  addressing the needs of specific diverse populations and other

30  underserved groups.

  1         (g)  The Arthritis Foundation, Florida Chapter, the

  2  Centers for Disease Control and Prevention, and the

  3  Association of State and Territorial Health Officials have led

  4  the development of a public health strategy, the National

  5  Arthritis Action Plan, to respond to this challenge.

  6         (h)  Educating the public and the health care community

  7  throughout the state about this devastating disease is of

  8  paramount importance and is in every respect in the public

  9  interest and to the benefit of all residents of the state.

10         (3)  PURPOSES.--The purposes of this section are to:

11         (a)  Create and foster a statewide program that

12  promotes public awareness and increases knowledge about the

13  causes of arthritis, the importance of early diagnosis and

14  appropriate management, effective prevention strategies, and

15  pain prevention and management.

16         (b)  Develop knowledge and enhance understanding of

17  arthritis by disseminating educational materials and

18  information on research results, services provided, and

19  strategies for prevention and education to patients, health

20  professionals, and the public.

21         (c)  Establish a solid scientific base of knowledge on

22  the prevention of arthritis and related disabilities through

23  surveillance, epidemiology, and prevention research.

24         (d)  Utilize educational and training resources and

25  services developed by organizations with appropriate expertise

26  and knowledge of arthritis and to use available technical

27  assistance.

28         (e)  Evaluate the need for improving the quality and

29  accessibility of existing community-based arthritis services.

30         (f)  Heighten awareness among state and local health

31  and human services officials, health professionals and

  1  providers, and policymakers about the prevention, detection,

  2  and treatment of arthritis.

  3         (g)  Implement and coordinate state and local programs

  4  and services to reduce the public health burden of arthritis.

  5         (h)  Provide lasting improvements in the delivery of

  6  health care for individuals with arthritis and their families,

  7  thus improving their quality of life while also containing

  8  health care costs.

  9         (4)  ARTHRITIS PREVENTION AND EDUCATION PROGRAM.--

10         (a)  Program establishment.--To the extent that funds

11  are specifically made available for this purpose, the

12  Department of Health shall establish, promote, and maintain an

13  arthritis prevention and education program to raise public

14  awareness, educate consumers, and educate and train health

15  professionals, teachers, and human services providers, and for

16  other purposes as provided in this section.

17         (b)  Needs assessment.--The department shall conduct a

18  needs assessment to identify:

19         1.  Epidemiological and other research on arthritis

20  being conducted within the state.

21         2.  Available technical assistance and educational

22  materials and programs on arthritis nationwide and within the

23  state.

24         3.  The level of public and professional awareness of

25  arthritis.

26         4.  The needs of people with arthritis, their families,

27  and caregivers.

28         5.  The educational and support service needs of health

29  care providers, including physicians, nurses, managed care

30  organizations, and other health care providers, relating to

31  arthritis.

  1         6.  The services available to persons with arthritis.

  2         7.  The existence of arthritis treatment,

  3  self-management, physical activity, and other education

  4  programs.

  5         8.  The existence of rehabilitation services for people

  6  with arthritis.

  7         (c)  Advisory panel on arthritis.--The department shall

  8  establish and coordinate an advisory panel on arthritis to

  9  provide nongovernmental input regarding the arthritis

10  prevention and education program. Membership shall include,

11  but is not limited to, persons with arthritis, public health

12  educators, medical experts on arthritis, providers of

13  arthritis health care, persons knowledgeable in health

14  promotion and education, and representatives of national

15  arthritis organizations and their local chapters.

16         (d)  Public awareness.--The department shall use, but

17  is not limited to, strategies consistent with the National

18  Arthritis Action Plan and existing state planning efforts to

19  raise public awareness and knowledge on the causes and nature

20  of arthritis, personal risk factors, the value of prevention

21  and early detection, ways to minimize preventable pain, and

22  options for diagnosing and treating the disease.

23         (5)  FUNDING.--

24         (a)  Contributions.--The Secretary of Health may accept

25  grants, services, and property from the Federal Government,

26  foundations, organizations, medical schools, and other

27  entities as may be available for the purposes of fulfilling

28  the obligations of this program.

29         (b)  Federal waivers.--The secretary shall seek any

30  federal waiver or waivers that may be necessary to maximize

31  funds from the Federal Government to implement this program.

  1         Section 2.  Prostate Cancer Awareness Program.--

  2         (1)  This section may be cited as the "Prostate Cancer

  3  Awareness Act of 2002."

  4         (2)  To the extent that funds are specifically made

  5  available for this purpose, the Prostate Cancer Awareness

  6  Program is established within the Department of Health. The

  7  purpose of this program is to implement the January 2000

  8  recommendations of the Florida Prostate Cancer Task Force to

  9  provide statewide outreach and health education activities to

10  ensure that men are aware of and appropriately seek medical

11  counseling for prostate cancer as an early detection health

12  care measure.

13         (3)  The program shall utilize known effective

14  strategies that may include, but are not limited to, radio and

15  television advertisements, newspaper articles and feature

16  stories, community education outreach programs, peer education

17  strategies, brochures, posters, videos, and computer-based

18  resources.

19         (4)  For purposes of implementing the program, the

20  Department of Health may:

21         (a)  Conduct activities directly or enter into a

22  contract with a qualified nonprofit community education

23  entity.

24         (b)  Seek any available gifts, grants, or funds from

25  the state, the Federal Government, philanthropic foundations,

26  and industry or business groups.

27         (5)  A prostate cancer advisory committee is created to

28  advise and assist the Department of Health in implementing the

29  program.

30         (a)  The Secretary of Health shall appoint the advisory

31  committee members, who shall consist of:

  1         1.  Three persons from prostate cancer survivor groups

  2  or cancer-related advocacy groups.

  3         2.  Three persons who are scientists or clinicians from

  4  public universities or research organizations.

  5         3.  Three persons who are practicing cancer medical

  6  specialists from health organizations with a commitment to

  7  cancer research and control.

  8         4.  One person who has health education and social

  9  marketing experience.

10         (b)  Members shall serve without compensation, but may,

11  pursuant to s. 112.061, Florida Statutes, receive

12  reimbursement for per diem and travel expenses incurred in the

13  performance of their official duties.

14         Section 3.  This act shall take effect July 1, 2002.
