  1                      A bill to be entitled

  2         An act relating to motor vehicle license

  3         plates; amending s. 320.089, F.S.; increasing

  4         the amount of revenue deposited into the Grants

  5         and Donations Trust Fund from the sale of

  6         license plates stamped with the words "National

  7         Guard," "Pearl Harbor Survivor,"

  8         "Combat-wounded veteran," or "U.S. Reserve";

  9         providing for the issuance, without payment of

10         the license tax, of Pearl Harbor Survivor

11         license plates or Purple Heart license plates

12         to certain disabled veterans; providing an

13         effective date.

15  Be It Enacted by the Legislature of the State of Florida:

16

17         Section 1.  Section 320.089, Florida Statutes, is

18  amended to read:

19         320.089  Members of National Guard and active United

20  States Armed Forces reservists; former prisoners of war;

21  survivors of Pearl Harbor; Purple Heart medal recipients;

22  special license plates; fee.--

23         (1)(a)  Each owner or lessee of an automobile or truck

24  for private use or recreational vehicle as specified in s.

25  320.08(9)(c) or (d), which is not used for hire or commercial

26  use, who is a resident of the state and an active or retired

27  member of the Florida National Guard, a survivor of the attack

28  on Pearl Harbor, a recipient of the Purple Heart medal, or an

29  active member of any branch of the United States Armed Forces

30  Reserve shall, upon application to the department, accompanied

31  by proof of active membership or retired status in the Florida

  1  National Guard, proof of membership in the Pearl Harbor

  2  Survivors Association or proof of active military duty in

  3  Pearl Harbor on December 7, 1941, proof of being a Purple

  4  Heart medal recipient, or proof of active membership in any

  5  branch of the Armed Forces Reserve, and upon payment of the

  6  license tax for the vehicle as provided in s. 320.08, be

  7  issued a license plate as provided by s. 320.06, upon which,

  8  in lieu of the serial numbers prescribed by s. 320.06, shall

  9  be stamped the words "National Guard," "Pearl Harbor

10  Survivor," "Combat-wounded veteran," or "U.S. Reserve," as

11  appropriate, followed by the serial number of the license

12  plate. Additionally, the Purple Heart plate may have the words

13  "Purple Heart" stamped on the plate and the likeness of the

14  Purple Heart medal appearing on the plate.

15         (b)  Notwithstanding any other provision of law to the

16  contrary, beginning with fiscal year 2002-2003 2000-2001 and

17  annually thereafter, the first $100,000 $50,000 in general

18  revenue generated from the sale of license plates issued under

19  this section which are stamped with the words "National

20  Guard," "Pearl Harbor Survivor," "Combat-wounded veteran," or

21  "U.S. Reserve" shall be deposited into the Grants and

22  Donations Trust Fund, as described in s. 296.38(2), to be used

23  for the purposes established by law for that trust fund.

24         (c)  Notwithstanding any provisions of law to the

25  contrary, an applicant for a Pearl Harbor Survivor license

26  plate or a Purple Heart license plate who also qualifies for a

27  disabled veteran's license plate under s. 320.084 shall be

28  issued the appropriate special license plate without payment

29  of the license tax imposed by s. 320.08.

30         (2)  Each owner or lessee of an automobile for private

31  use, truck weighing not more than 5,000 pounds, or

  1  recreational vehicle as specified in s. 320.08(9)(c) or (d),

  2  which is not used for hire or commercial use, who is a

  3  resident of the state and who is a former prisoner of war, or

  4  their unremarried surviving spouse, shall, upon application

  5  therefor to the department, be issued a license plate as

  6  provided in s. 320.06, on which license plate are stamped the

  7  words "Ex-POW" followed by the serial number. Each application

  8  shall be accompanied by proof that the applicant meets the

  9  qualifications specified in paragraph (a) or paragraph (b).

10         (a)  A citizen of the United States who served as a

11  member of the Armed Forces of the United States or the armed

12  forces of a nation allied with the United States who was held

13  as a prisoner of war at such time as the Armed Forces of the

14  United States were engaged in combat, or their unremarried

15  surviving spouse, may be issued the special license plate

16  provided for in this subsection without payment of the license

17  tax imposed by s. 320.08.

18         (b)  A person who was serving as a civilian with the

19  consent of the United States Government, or a person who was a

20  member of the Armed Forces of the United States who was not a

21  United States citizen and was held as a prisoner of war when

22  the Armed Forces of the United States were engaged in combat,

23  or their unremarried surviving spouse, may be issued the

24  special license plate provided for in this subsection upon

25  payment of the license tax imposed by s. 320.08.

26         (3)  Each owner or lessee of an automobile for private

27  use, truck weighing not more than 5,000 pounds, or

28  recreational vehicle as specified in s. 320.08(9)(c) or (d),

29  which is not used for hire or commercial use, who is a

30  resident of this state and who is the unremarried surviving

31  spouse of a recipient of the Purple Heart medal shall, upon

  1  application therefor to the department, with the payment of

  2  the required fees, be issued a license plate as provided in s.

  3  320.06, on which license plate are stamped the words "Purple

  4  Heart" and the likeness of the Purple Heart medal followed by

  5  the serial number.  Each application shall be accompanied by

  6  proof that the applicant is the unremarried surviving spouse

  7  of a recipient of the Purple Heart medal.

  8         Section 2.  This act shall take effect July 1, 2002.

                       COMMITTEE SUBSTITUTE FOR
11                              SB 568

13  The Committee Substitute increases the license tax
    distribution from the sale of  "National Guard", "Pearl Harbor
14  Survivor", "Combat-Wounded Veteran, "U.S. Reserve", and
    "Purple Heart" license plates to the Grants and Donations
15  Trust Fund of the Department of Veterans Affairs, from $50,000
    to $100,000 beginning in fiscal year 2002-03.
