14 On page 27, between lines 5 & 6,

16 insert:
17 Section 19. Subsection (20) of section 400.141,
18 Florida Statutes, is amended to read:
19 400.141 Administration and management of nursing home
20 facilities.--Every licensed facility shall comply with all
21 applicable standards and rules of the agency and shall:
22 (20) Maintain general and professional liability
23 insurance coverage that is in force at all times. However, a
24 state-designated teaching nursing home created under s. 430.80
25 may demonstrate proof of financial responsibility as provided
26 in s. 430.80(3)(h).
27 Section 20. Paragraph (h) is added to subsection (3)
28 of section 430.80, Florida Statutes, to read:
29 430.80 Implementation of a teaching nursing home pilot
30 project.--
31 (3) To be designated as a teaching nursing home, a

1 nursing home licensee must, at a minimum:
2 (h) Maintain proof of financial responsibility in a
3 minimum amount of $750,000. Such proof of financial
4 responsibility may include:
5 1. Maintaining an escrow account consisting of cash or
6 assets eligible for deposit in accordance with s. 625.52; or
7 2. Obtaining and maintaining pursuant to chapter 675
8 an unexpired, irrevocable, nontransferable and nonassignable
9 letter of credit issued by any bank or savings association
10 organized and existing under the laws of this state or any
11 bank or savings association organized under the laws of the
12 United States that has its principal place of business in this
13 state or has a branch office which is authorized to receive
14 deposits in this state. The letter of credit shall be payable
15 to the facility as the beneficiary upon presentment of a final
16 judgment indicating liability and awarding damages to be paid
17 by the facility or upon presentment of a settlement agreement
18 signed by all parties to the agreement when such final
19 judgment or settlement is a result of a liability claim
20 against the facility.
