15 On page 1, between lines 16 & 17 of the amendment

17 insert: Section 1. Effective upon this act becoming a law,
18 section 20.10, Florida Statutes, is amended to read:
19 20.10 Department of State.--There is created a
20 Department of State.
21 (1) The head of the Department of State is the
22 Secretary of State.
23 (2) The following divisions of the Department of State
24 are established:
25 (a) Division of Elections.
26 (b) Division of Historical Resources.
27 (c) Division of Corporations.
28 (d) Division of Library and Information Services.
29 (e) Division of Licensing.
30 (f) Division of Cultural Affairs.
31 (g) Division of Administration.

1 (3) The Department of State may adopt rules pursuant
2 to ss. 120.536(1) and 120.54 to administer the provisions of
3 law conferring duties upon the department.
4 (4)(a) Notwithstanding any other provision of law, the
5 Secretary of State is hereby designated as the state official
6 responsible for submitting, and is hereby authorized and
7 directed to submit, any legislative or congressional
8 redistricting plans to the United States Department of Justice
9 to the extent preclearance is required for all or part of
10 these plans pursuant to Section 5 of the federal Voting Rights
11 Act of 1965, as amended (42 U.S.C. Sec. 1973c). The Secretary
12 of State is also authorized to choose and hire outside counsel
13 to represent the Secretary in obtaining preclearance and
14 defending any litigation filed challenging any legislative or
15 the congressional redistricting plans.
16 (b) Notwithstanding any other provision of law, the
17 Secretary of State, the Florida Senate, and the Florida House
18 of Representatives shall each be a proper party and shall each
19 have the right to choose and hire outside counsel to represent
20 their respective interests in, any litigation challenging any
21 legislative or congressional redistricting plan and to
22 intervene in any action involving the validity or application
23 of any statute that affects any state legislation or
24 congressional district.
