  1                      A bill to be entitled

  2         An act relating to commercial transportation;

  3         providing a penalty for the illegal use of any

  4         means of public or commercial transportation or

  5         conveyance to commit any felony or to

  6         facilitate the commission of any felony;

  7         providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Commercial transportation; penalty for use

12  in commission of a felony.--

13         (1)  It is unlawful for any person to attempt to

14  obtain, solicit to obtain, or obtain any means of public or

15  commercial transportation or conveyance, including vessels,

16  aircraft, railroad trains, or commercial vehicles as defined

17  in section 316.003(66), Florida Statutes, with the intent to

18  use such public or commercial transportation or conveyance to

19  commit any felony or to facilitate the commission of any

20  felony.

21         (2)  Any person who violates the provisions of

22  subsection (1) commits a felony of the third degree,

23  punishable as provided for in section 775.082, section

24  775.083, or section 775.084, Florida Statutes.

25         Section 2.  This act shall take effect July 1, 2002.
