18 insert: Section 3. Effective upon this act becoming a law,
19 section 20.10, Florida Statutes, is amended to read:
20 20.10 Department of State.--There is created a
21 Department of State.
22 (1) The head of the Department of State is the
23 Secretary of State.
24 (2) The following divisions of the Department of State
25 are established:
26 (a) Division of Elections.
27 (b) Division of Historical Resources.
28 (c) Division of Corporations.
29 (d) Division of Library and Information Services.
30 (e) Division of Licensing.
31 (f) Division of Cultural Affairs.

1 (g) Division of Administration.
2 (3) The Department of State may adopt rules pursuant
3 to ss. 120.536(1) and 120.54 to administer the provisions of
4 law conferring duties upon the department.
5 (4)(a) Notwithstanding any other provision of law, the
6 Secretary of State is hereby designated as the state official
7 responsible for submitting, and is hereby authorized and
8 directed to submit, any legislative or congressional
9 redistricting plans to the United States Department of Justice
10 to the extent preclearance is required for all or part of
11 these plans pursuant to Section 5 of the federal Voting Rights
12 Act of 1965, as amended (42 U.S.C. Sec. 1973c). The Secretary
13 of State is also authorized to choose and hire outside counsel
14 to represent the Secretary in obtaining preclearance and
15 defending any litigation filed challenging any legislative or
16 the congressional redistricting plans.
17 (b) Notwithstanding any other provision of law, the
18 Secretary of State, the Florida Senate, and the Florida House
19 of Representatives shall each be a proper party and shall each
20 have the right to choose and hire outside counsel to represent
21 their respective interests in, any litigation challenging any
22 legislative or congressional redistricting plan and to
23 intervene in any action involving the validity or application
24 of any statute that affects any state legislation or
25 congressional district.
