  1                      A bill to be entitled

  2         An act relating to trust funds; creating the

  3         Workers' Compensation Administration Trust Fund

  4         within the Department of Education; providing

  5         for purposes and sources of funds; providing

  6         for annual carryforward of fund balances;

  7         providing for future review and termination or

  8         re-creation of the trust fund; providing an

  9         effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Workers' Compensation Administration Trust

14  Fund within the Department of Education.--

15         (1)  The Workers' Compensation Administration Trust

16  Fund is created within the Department of Education, to be

17  administered by such department.  The trust fund shall be used

18  for the purpose of providing funds for the payment of all

19  expenses in respect to the administration of programs for the

20  rehabilitation and reemployment of injured workers, pursuant

21  to legislative appropriation or an approved amendment to the

22  department's operating budget pursuant to the provisions of

23  chapter 216, Florida Statutes.

24         (2)  Notwithstanding the provisions of section 216.301,

25  Florida Statutes, and pursuant to section 216.351, Florida

26  Statutes, any balance in the trust fund at the end of any

27  fiscal year shall remain in the trust fund at the end of the

28  year and shall be available for carrying out the purposes of

29  the trust fund.

30         (3)  Pursuant to the provisions of Section 19(f)(2),

31  Article III of the State Constitution, the trust fund shall,

  1  unless terminated sooner, be terminated on July 1, 2006.

  2  Prior to its scheduled termination, the trust fund shall be

  3  reviewed as provided in section 215.3206, Florida Statutes.

  4         Section 2.  This act shall take effect July 1, 2002.
