  1                      A bill to be entitled

  2         An act relating to military-separation forms;

  3         providing process for removal from official

  4         records of armed forces military-separation

  5         forms; providing exceptions; providing an

  6         effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Any veteran of the United States Armed

11  Forces or his or her widow or widower, attorney, personal

12  representative, executor, or court appointed guardian has the

13  right to request that a county recorder remove from the

14  official records any of the following forms recorded before,

15  on, or after the effective date of this act, by or on behalf

16  of the requesting veteran: DD-214; DD-215; WD AGO 53; WD AGO

17  55; WD AGO 53-55; NAVMC 78-PD; and NAVPERS 553. The request

18  must specify the identification page number of the form to be

19  removed. The request shall be made in person and with

20  appropriate identification to allow determination of the

21  identity of the requested. The county recorder has no duty to

22  inquire beyond the request to verify the identity of the

23  person requesting the removal. No fee shall be charged for the

24  removal. When the request for removal is made, the county

25  recorder shall provide a written notice to the requesting

26  party that the removal of the document from the official

27  records is permanent and no further record of the document

28  will exist in the official records of the county.

29         Section 2.  This act shall take effect upon becoming a

30  law.
