13         Amendment (with title amendment) 
14         On page 46, between lines 19 and 20, of the bill
15  
16  insert:  
17         Section 51.  In order to implement Specific
18  Appropriation 2075 of the 2002-2003 General Appropriations
19  Act, subsection (10) of section 339.12, Florida Statutes, as
20  created by section 83 of chapter 2002-20, Laws of Florida, is
21  amended to read:
22         339.12  Aid and contributions by governmental entities
23  for department projects; federal aid.--
24         (10)  Beginning with the 2003-2004 fiscal year, any
25  county with a population greater than 50,000 that levies the
26  full 6 cents of local option fuel tax pursuant to ss.
27  206.41(1)(e) and 206.87(1)(c), or that dedicates 35 percent or
28  more of its discretionary sales surtax, pursuant to s.
29  212.055, for improvements to the state transportation system
30  or to local projects directly upgrading the state
31  transportation system within the county's boundaries shall

 1  receive preference for receipt of any transportation grant for
 2  which the county applies. This subsection shall not apply to
 3  loans or nonhighway grant programs.
