13         Senate Amendment (with title amendment) 
14         On page 4, lines 6-8, delete those lines
15  
16  and insert:  
17         Section 3.  Section 230.235, Florida Statutes, is
18  amended to read:
19         230.235  Policy of zero tolerance for crime and
20  victimization; public records exemption.--
21         (4)  PUBLIC RECORDS EXEMPTION.--The name, student ID
22  number, or any other personal identifying information of any
23  student who reports the presence of illegal drugs as defined
24  in chapter 893 or a weapon or firearm as described by chapter
25  790, on or off any school campus, or who reports impending or
26  suspected activities that may result in injury or death to any
27  person on or off any school campus, held by a school principal
28  or the school principal's staff shall be exempt from the
29  provisions of s. 119.07(1) and s. 24(a), Art. I of the State
30  Constitution. Such exempt information shall not be disclosed
31  to any person or entity not approved by the school principal

SENATE AMENDMENT Bill No. SB 78-E Amendment No. ___ Barcode 065272 1 or the school principal's designee, except that such 2 information shall be disclosed to the reporting student's 3 parent or legal guardian or law enforcement authorities if 4 such information is requested by the reporting student's 5 parent or legal guardian or by law enforcement authorities. 6 Should information reported by a student result in a criminal, 7 civil, or administrative proceeding, the exempt status of the 8 reporting student's name, student ID or personal identifying 9 information must be maintained until the reporting student 10 attains the age of 18 years and thereafter unless a court of 11 competent jurisdiction authorizes release of such information 12 for good cause shown. This exemption applies to such 13 information held by a school principal or the school 14 principal's staff before, on, or after the effective date of 15 this exemption. This exemption is subject to the Open 16 Government Sunset Review Act of 1995 in accordance with s. 17 119.15, and shall stand repealed on October 2, 2007, unless 18 reviewed and saved from repeal through reenactment by the 19 Legislature. 20 Section 4. The Legislature finds that it is a public 21 necessity that the name, student ID number or other personal 22 identifying information of a student who reports the presence 23 of illegal drugs or a weapon or firearm, or who reports 24 impending or suspected activities that may result in injury or 25 death to any person, held by a school principal or the school 26 principal's staff be made exempt from public disclosure, 27 because release of the reporting student's name could place 28 the student in danger. Furthermore, release of such student's 29 name would impair the effective and efficient administration 30 of any school program designed to provide students with the 31 opportunity to anonymously report illegal activities that 2 7:06 PM 05/07/02 s0078E.go16.ee

Without identity 2 protection, students would more likely be reluctant to 3 participate in a program. 4 Section 5. Sections 1 and 2 of this act shall take 5 effect July 1, 2002, if Senate Bill 20-E or similar 6 legislation is adopted in the same legislative session or an 7 extension thereof and becomes law. Sections 3 and 4 of this 8 act shall take effect upon becoming law. 9 10 11 ================ T I T L E A M E N D M E N T =============== 12 And the title is amended as follows: 13 On page 1, lines 3-14, delete those lines 14 15 and insert: 16 for the confidentiality of certain information 17 held by educational institutions; providing for 18 the confidentiality of certain information held 19 by the Florida Alzheimer's Center and Research 20 Institute and others; creating an exemption 21 from the public-records provisions of the State 22 Constitution and Florida law for certain 23 information relating to clients, patients, and 24 donors, as well as medical and health records 25 and certain proprietary and trade-secret 26 information; providing a statement of public 27 necessity for such exemptions; providing for 28 future repeal; providing a contingent effective 29 date; creating an exemption for personal 30 identifying information of students who report 31 certain illegal activities; providing 3 7:06 PM 05/07/02 s0078E.go16.ee
