1 A reviser's bill to be entitled
2          An act relating to the Florida Statutes; amending ss.
3    411.226, 1011.31, 1011.42, and 1013.12, F.S., to conform
4    to the directive in s. 1, ch. 93-199, Laws of Florida, to
5    remove gender-specific references applicable to human
6    beings from the Florida Statutes without substantive
7    change in legal effect.

9          Be It Enacted by the Legislature of the State of Florida:
10         
11          Section 1. Paragraph (f) of subsection (2) of section
12    411.226, Florida Statutes, is amended to read:
13          411.226 Learning Gateway.--
14          (2) LEARNING GATEWAY STEERING COMMITTEE.--
15          (f) Steering committee appointments must be made, and the
16    committee must hold its first meeting, within 90 days after this
17    act takes effect. Steering committee members shall be appointed
18    to serve a term of 3 years. The Governor shall designate the
19    chairchairmanof the steering committee.
20          Section 2. Subsection (2) of section 1011.31, Florida
21    Statutes, is amended to read:
22          1011.31 Current loans to community college boards of
23    trustees.--
24          (2) The Commissioner of Education shall approve such
25    proposal when, in his or heropinion, the proposal is reasonable
26    and just, the expenditure is necessary, and revenues sufficient
27    to meet the requirements of the loan can reasonably be
28    anticipated.
29          Section 3. Subsection (6) of section 1011.42, Florida
30    Statutes, is amended to read:
31          1011.42 University depositories; deposits into and
32    withdrawals from depositories.--
33          (6) The university president or his or herdesignee, after
34    having been specifically authorized by the university board of
35    trustees, may transfer funds from one depository to another,
36    within a depository, to another institution, or from another
37    institution to a depository for investment purposes and may
38    transfer funds in a similar manner when the transfer does not
39    represent an expenditure, advance, or reduction of cash assets.
40          Section 4. Subsection (7) of section 1013.12, Florida
41    Statutes, is amended to read:
42          1013.12 Casualty, safety, sanitation, and firesafety
43    standards and inspection of property.--The State Board of
44    Education shall adopt and administer rules prescribing standards
45    for the safety and health of occupants of educational and
46    ancillary plants as a part of State Requirements for Educational
47    Facilities or the Florida Building Code for educational
48    facilities construction as provided in s. 1013.37, except that
49    the State Fire Marshal in consultation with the Department of
50    Education shall adopt uniform firesafety standards for
51    educational and ancillary plants and educational facilities, as
52    provided in s. 633.022(1)(b), and a firesafety evaluation system
53    to be used as an alternate firesafety inspection standard for
54    existing educational and ancillary plants and educational
55    facilities. The uniform firesafety standards and the alternate
56    firesafety evaluation system shall be administered and enforced
57    by local fire officials. These standards must be used by all
58    public agencies when inspecting public educational and ancillary
59    plants, and the firesafety standards must be used by local fire
60    officials when performing firesafety inspections of public
61    educational and ancillary plants and educational facilities. In
62    accordance with such standards, each board shall prescribe
63    policies and procedures establishing a comprehensive program of
64    safety and sanitation for the protection of occupants of public
65    educational and ancillary plants. Such policies must contain
66    procedures for periodic inspections as prescribed herein and for
67    withdrawal of any educational and ancillary plant, or portion
68    thereof, from use until unsafe or unsanitary conditions are
69    corrected or removed.
70          (7) ANNUAL REPORT.--The State Fire Marshal shall publish
71    an annual report to be filed with the substantive committees of
72    the state House of Representatives and Senate having
73    jurisdiction over education, the Commissioner of Education or
74    his or hersuccessor, and the Governor documenting the status of
75    each board's firesafety program, including the improvement or
76    lack thereof.

79    the Legislature in s. 1, ch. 93-199, Laws of Florida,
80    to remove gender-specific references applicable to
81    human beings from the Florida Statutes without
82    substantive change in legal effect.

84          Section 5. This act shall take effect on the 60th day
85    after adjournment sine die of the session of the Legislature in
86    which enacted.
