An act relating to a public records exemption for certain |

information contained in a rabies vaccination certificate; |

amending s. 828.30, F.S.; narrowing the exemption; |
|

|
specifying exempt information; adding clarifying language; |
|

|
making editorial changes; eliminating the condition of |
|
7
|
making a written request in order to view or copy rabies |
|
8
|
vaccination certificates; removing superfluous language; |
|
9
|
removing the October 2, 2003, repeal thereof scheduled |
|
10
|
pursuant to the Open Government Sunset Review Act of 1995; |
|
11
|
providing an effective date. |

Be It Enacted by the Legislature of the State of Florida: |
|

|
|
|

|
Section 1. Notwithstanding the October 2, 2003, repeal of |
|
16
|
said subsection scheduled pursuant to the Open Government Sunset |
|
17
|
Review Act of 1995, subsection (5) of section 828.30, Florida |
|
18
|
Statutes, is amended to read: |
|
19
|
828.30 Rabies vaccination of dogs, cats, and ferrets.-- |
|
20
|
(5) An animal owner’s name, street address, phone number, |
|
21
|
and animal tag numberAny information contained in atherabies |
|
22
|
vaccination certificate provided to the animal control authority |
|
23
|
which identifies the owner of the animal vaccinated is |
|
24
|
confidential andexempt from s. 119.07(1) and s. 24(a), Art. I |
|
25
|
of the State Constitution. However, the physician of, or,any |
|
26
|
person who has been bitten, scratched, or otherwise exposed to a |
|
27
|
zoonotic disease or the physician of such person;anda |
|
28
|
veterinarian who is treating an animal that has been bitten, |
|
29
|
scratched, or otherwise exposed to a zoonotic disease;or the |
|
30
|
owner of an animal that has been bitten, scratched, or otherwise |
|
31
|
exposed to a zoonotic disease,shall be provided with any |
|
32
|
information contained in a rabies vaccination certificate but |
|
33
|
only with respect to the particular animal biting, scratching, |
|
34
|
or otherwise causing exposure. Any person with an animal tag |
|
35
|
number may receive vaccination certificate information with |
|
36
|
regard to that animal. Federal, state, and localLaw enforcement |
|
37
|
and prosecutorial agencies; other animal control authorities; |
|
38
|
and emergency and medical response and, disease control |
|
39
|
agencies;,or other governmental health agencies shall be |
|
40
|
provided information contained in the rabies vaccination |
|
41
|
certificate for the purpose of controlling the transmission of |
|
42
|
rabies; however, the receiving agencies and authoritiesthey |
|
43
|
must not release the exemptsuch information to the public. Any |
|
44
|
person, pursuant to a written request, may view or copy any |
|
45
|
individual rabies vaccination certificate, one record at a time. |
|
46
|
A copy of any existing database may be obtained provided that |
|
47
|
the owner's name, street address, and phone number, and the |
|
48
|
animal tag number, are not made available. |
|

|

This exemption is subject to the Open Government Sunset Review |
|
51
|
Act of 1995 in accordance with s. 119.15, and shall stand |
|
52
|
repealed on October 2, 2003, unless reviewed and saved from |
|
53
|
repeal through reenactment by the Legislature.

|
Section 2. This act shall take effect October 1, 2003. |
