1 A bill to be entitled
2 An act relating to crimes against children;
3 creating s. 938.10, F.S.; imposing an
4 additional court cost against persons who plead
5 guilty or nolo contendere to, or who are found
6 guilty of, certain crimes against minors;
7 requiring the clerk of the court to deposit the
8 proceeds of the court cost into the State
9 Treasury for deposit into a specified trust
10 fund to be used to fund children's advocacy
11 centers; requiring the clerk of the court to
12 retain a portion of the court cost as a service
13 charge; requiring annual reports; requiring a
14 report to the Legislature; providing an
15 effective date.

17 Be It Enacted by the Legislature of the State of Florida:
18
19 Section 1. Section 938.10, Florida Statutes, is
20 created to read:
21 938.10 Additional court cost imposed in cases of
22 certain crimes against minors.--
23 (1) If a person pleads guilty or nolo contendere to,
24 or is found guilty of, regardless of adjudication, any offense
25 against a minor in violation of s. 784.085, chapter 787,
26 chapter 794, s. 796.03, s. 800.04, chapter 827, s. 847.0145,
27 or s. 985.4045, the court shall impose a court cost of $101
28 against the offender in addition to any other cost or penalty
29 required by law.
30 (2) Each month the clerk of the court shall transfer
31 the proceeds of the court cost, less $1 from each sum

1 collected, which the clerk shall retain as a service charge,
2 to the State Treasury for deposit into the Child Advocacy
3 Trust Fund for disbursement to the Florida Network of
4 Children's Advocacy Centers, Inc., for the purpose of funding
5 children's advocacy centers that are members of the network.
6 (3) At the end of each fiscal year each children's
7 advocacy center receiving revenue from the Child Advocacy
8 Trust Fund must provide a report to the Board of Directors of
9 the Florida Network of Children's Advocacy Centers, Inc.,
10 which reflects center expenditures, all sources of revenue
11 received, and outputs that have been standardized and agreed
12 upon by network members and the board of directors, such as
13 the number of clients served, client demographic information,
14 and number and types of services provided. The Florida Network
15 of Children's Advocacy Centers, Inc., must compile reports
16 from the centers and provide a report to the President of the
17 Senate and the Speaker of the House of Representatives in
18 August of each year beginning in 2004.
19 Section 2. This act shall take effect July 1, 2003.

24 Specifies that funds generated are to be disbursed to the
Florida Network of Children's Advocacy Centers, Inc., for
25 distribution instead of given directly to child advocacy
centers that are members of the network.

Requires annual reports by the Children's Advocacy Centers to
27 the Florida Network of Children's Advocacy Center's, Inc.,
which reflect center expenditures, sources of revenue received
28 and standardized outputs to include the number of clients
served, client demographic information, number and types of
29 services delivered.
30 Directs the Florida Network of Children's Advocacy Centers,
Inc., to compile reports received from the centers and provide
31 a report to the Legislature annually.
