1 A bill to be entitled
2          An act relating to participation in insurance plans;
3    amending ss. 255.05 and 287.057, F.S.; prohibiting the
4    requirement that contractors or subcontractors under
5    certain contracts participate in, or be penalized for
6    nonparticipation in, certain insurance plans; providing an
7    effective date.
8         
9          Be It Enacted by the Legislature of the State of Florida:
10         
11          Section 1. Subsection (10) is added to section 255.05,
12    Florida Statutes, to read:
13          255.05 Bond of contractor constructing public buildings;
14    form; action by materialmen.--
15          (10) A party to a contract to which this section applies
16    may not require a contractor or a subcontractor to participate
17    in, and a party may not be penalized for not participating in,
18    an insurance plan controlled by an owner or contractor under
19    which plan an owner or contractor, or an agent of the owner or
20    contractor, obtains insurance coverage for contractors and
21    subcontractors relating to a project or group of related
22    projects, including, but not limited to, workers' compensation,
23    employer's liability, general liability, or builder's risk
24    insurance.
25          Section 2. Subsection (25) is added to section 287.057,
26    Florida Statutes, to read:
27          287.057 Procurement of commodities or contractual
28    services.--
29          (25) A party to a contract to which this section applies
30    may not require a contractor or a subcontractor to participate
31    in, and a party may not be penalized for not participating in,
32    an insurance plan controlled by an owner or contractor under
33    which plan an owner or contractor, or an agent of the owner or
34    contractor, obtains insurance coverage for contractors and
35    subcontractors relating to a project or group of related
36    projects, including, but not limited to, workers' compensation,
37    employer's liability, general liability, or builder's risk
38    insurance.
39          Section 3. This act shall take effect upon becoming a law.
