11          An act relating to Department of Corrections personnel;
12    amending s. 110.205, F.S.; deleting from career service
13    exemption provisions obsolete language relating to the
14    Correctional Education Program; classifying colonels and
15    majors within the Department of Corrections as Selected
16    Exempt Service employees; providing an effective date.

18          Be It Enacted by the Legislature of the State of Florida:
19         
20          Section 1. Paragraphs (d) and (m) of subsection (2) of
21    section 110.205, Florida Statutes, are amended to read:
22          110.205 Career service; exemptions.--
23          (2) EXEMPT POSITIONS.--The exempt positions that are not
24    covered by this part include the following:
25          (d) All officers and employees of the state universities
26    and the Correctional Education Program within the Department of
27    Corrections,and the academic personnel and academic
28    administrative personnel of the Florida School for the Deaf and
29    the Blind. In accordance with the provisions of s. 1002.36, the
30    salaries for academic personnel and academic administrative
31    personnel of the Florida School for the Deaf and the Blind shall
32    be set by the board of trustees for the school, subject only to
33    the approval of the State Board of Education. The salaries for
34    all instructional personnel and all administrative and
35    noninstructional personnel of the Correctional Education Program
36    shall be set by the Department of Corrections, subject to the
37    approval of the Department of Management Services.
38          (m) All assistant division director, deputy division
39    director, and bureau chief positions in any department, and
40    those positions determined by the department to have managerial
41    responsibilities comparable to such positions, which positions
42    include, but are not limited to:,
43          1. Positions in the Department of Health and,the
44    Department of Children and Family Services, and the Department
45    of Correctionsthat are assigned primary duties of serving as
46    the superintendent or assistant superintendent of an
47    institution., or
48          2. Positions in the Department of Corrections that are
49    assigned primary duties of serving as the warden,orassistant
50    warden, colonel, or major of an institution or; positions in the
51    Department of Correctionsthat are assigned primary duties of
52    serving as the circuit administrator or deputy circuit
53    administrator.;
54          3.Positions in the Department of Transportation that are
55    assigned primary duties of serving as regional toll managers and
56    managers of offices as defined in s. 20.23(3)(d)3. and (4)(d).;
57          4.Positions in the Department of Environmental Protection
58    that are assigned the duty of an Environmental Administrator or
59    program administrator.; and
60          5.Positions in the Department of Health that are assigned
61    the duties of Environmental Administrator, Assistant County
62    Health Department Director, and County Health Department
63    Financial Administrator.
64         
65          Unless otherwise fixed by law, the department shall set the
66    salary and benefits of thethese positions listed in this
67    paragraphin accordance with the rules established for the
68    Selected Exempt Service.
69          Section 2. This act shall take effect July 1, 2003.
