| 1 | A bill to be entitled | ||
| 2 | An act relating to assault; amending s. 901.15, F.S.; | ||
| 3 | providing a law enforcement officer may make an arrest | ||
| 4 | without a warrant under certain circumstances when an | ||
| 5 | assault is made upon another person in that person’s | ||
| 6 | workplace; providing for immunity from civil liability | ||
| 7 | under certain circumstances; providing a definition; | ||
| 8 | providing an effective date. | ||

| 10 | Be It Enacted by the Legislature of the State of Florida: | ||
| 11 | |||
| 12 | Section 1. Subsection (9) of section 901.15, Florida | ||
| 13 | Statutes, is amended to read: | ||
| 14 | 901.15 When arrest by officer without warrant is | ||
| 15 | lawful.--A law enforcement officer may arrest a person without a | ||
| 16 | warrant when: | ||
| 17 | (9) There is probable cause to believe that the person has | ||
| 18 | committed: | ||
| 19 | (a) Any battery upon another person, as defined in s. | ||
| 20 | 784.03. | ||
| 21 | (b) An act of criminal mischief or a graffiti-related | ||
| 22 | offense as described in s. 806.13. | ||
| 23 | (c) An assault upon another person, as defined in s. | ||
| 24 | 784.011, when the assault is committed in the workplace of the | ||
| 25 | person assaulted. A law enforcement officer who acts in good | ||
| 26 | faith and exercises due care in making an arrest under this | ||
| 27 | paragraph is immune from civil liability that otherwise might | ||
| 28 | result by reason of his or her action. For the purposes of this | ||
| 29 | paragraph, the term “workplace” means a single physical location | ||
| 30 | where business is conducted or services or operations are | ||
| 31 | performed and includes the area within 100 feet of that | ||
| 32 | location. | ||
| 33 | Section 2. This act shall take effect upon becoming a law. | ||
