1 A bill to be entitled
2          An act relating to adult protective services; amending s.
3    415.1045, F.S.; requiring the Department of Children and
4    Family Services to enter into certain working agreements
5    with local law enforcement agencies by September 1, 2003;
6    requiring a report; providing an effective date.

8          Be It Enacted by the Legislature of the State of Florida:
9         
10          Section 1. Subsection (6) of section 415.1045, Florida
11    Statutes, is amended to read:
12          415.1045 Photographs, videotapes, and medical
13    examinations; abrogation of privileged communications;
14    confidential records and documents.--
15          (6) WORKING AGREEMENTS.--By September 1, 2003,the
16    department shall enter into working agreements with the
17    jurisdictionally responsible county sheriffs' office or local
18    police department that will be the lead agency when conducting
19    any criminal investigation arising from an allegation of abuse,
20    neglect, or exploitation of a vulnerable adult. The working
21    agreement must specify how the requirements of this chapter will
22    be met. The department shall conduct a review of the efficacy of
23    the agreements by September 1, 2004.For the purposes of such
24    agreement, the jurisdictionally responsible law enforcement
25    entity is authorized to share Florida criminal history and local
26    criminal history information that is not otherwise exempt from
27    s. 119.07(1) with the district personnel. A law enforcement
28    entity entering into such agreement must comply with s.
29    943.0525. Criminal justice information provided by such law
30    enforcement entity shall be used only for the purposes specified
31    in the agreement and shall be provided at no charge.
32    Notwithstanding any other provision of law, the Department of
33    Law Enforcement shall provide to the department electronic
34    access to Florida criminal justice information which is lawfully
35    available and not exempt from s. 119.07(1), only for the purpose
36    of protective investigations and emergency placement. As a
37    condition of access to such information, the department shall be
38    required to execute an appropriate user agreement addressing the
39    access, use, dissemination, and destruction of such information
40    and to comply with all applicable laws and rules of the
41    Department of Law Enforcement.
42          Section 2. This act shall take effect July 1, 2003.
