| 1 | A bill to be entitled | ||
| 2 | An act relating to the Florida Free Gift Advertising Law; | ||
| 3 | amending s. 817.415, F.S.; requiring persons who offer | ||
| 4 | free merchandise to charge the consumer who accepts such | ||
| 5 | offer no more for shipping and handling than the actual | ||
| 6 | cost incurred by the shipper; providing an effective date. | ||

| 8 | Be It Enacted by the Legislature of the State of Florida: | ||
| 9 | |||
| 10 | Section 1. Subsection (4) of section 817.415, Florida | ||
| 11 | Statutes, is amended to read: | ||
| 12 | 817.415 Florida Free Gift Advertising Law.-- | ||
| 13 | (4) RESTRICTIONS ON USE OF WORD "FREE."--Any item or | ||
| 14 | portion of an item unconditionally offered as "free" shall in | ||
| 15 | fact be free, without obligation or requirement of consideration | ||
| 16 | in any form, when accepted in writing within the time limit set | ||
| 17 | forth in the advertisement or within a reasonable time, if no | ||
| 18 | time limit is so set. However, any person so receiving and | ||
| 19 | accepting such offer may be required to pay any necessary | ||
| 20 | transportation or delivery charges directly to the United States | ||
| 21 | Postal Service or other regulated public carrier. Such charges, | ||
| 22 | however, may not exceed the actual shipping or handling charges | ||
| 23 | incurred by the person who offers such free merchandise. | ||
| 24 | Section 2. This act shall take effect July 1, 2003. | ||
