1 A bill to be entitled
2          An act relating to the Florida Free Gift Advertising Law;
3    amending s. 817.415, F.S.; requiring persons who offer
4    free merchandise to charge the consumer who accepts such
5    offer no more for shipping and handling than the actual
6    cost incurred by the shipper; providing an effective date.

8          Be It Enacted by the Legislature of the State of Florida:
9         
10          Section 1. Subsection (4) of section 817.415, Florida
11    Statutes, is amended to read:
12          817.415 Florida Free Gift Advertising Law.--
13          (4) RESTRICTIONS ON USE OF WORD "FREE."--Any item or
14    portion of an item unconditionally offered as "free" shall in
15    fact be free, without obligation or requirement of consideration
16    in any form, when accepted in writing within the time limit set
17    forth in the advertisement or within a reasonable time, if no
18    time limit is so set. However, any person so receiving and
19    accepting such offer may be required to pay any necessary
20    transportation or delivery charges directly to the United States
21    Postal Service or other regulated public carrier. Such charges,
22    however, may not exceed the actual shipping or handling charges
23    incurred by the person who offers such free merchandise.
24          Section 2. This act shall take effect July 1, 2003.
