An act relating to the City of Hialeah; providing for the |
|

|
relief of Asbel Llerena; authorizing and directing the |
|
4
|
City of Hialeah to compensate him for personal injuries |
|
5
|
and the death of Maria de Jesus Llerena due to the |
|
6
|
negligence of a City of Hialeah employee; providing an |
|
7
|
effective date. |

WHEREAS, on July 11, 1999, Maria de Jesus Llerena was a |
|
10
|
passenger in a car driven by Asbel Llerena, her husband, heading |
|
11
|
west on West 29th Street in Hialeah, and |
|
12
|
WHEREAS, at the same time, a City of Hialeah rookie police |
|
13
|
officer, Alexis Casteneda, was driving south on West 8th Avenue |
|
14
|
in Hialeah in response to a call, and |
|
15
|
WHEREAS, there was a collision at the intersection where |
|
16
|
many witnesses indicated that Officer Castaneda had a red light |
|
17
|
and failed to yield the right-of-way to Mr. Llerena who was |
|
18
|
driving through the intersection with a green light, and |
|
19
|
WHEREAS, the incident has been litigated and the parties |
|
20
|
have reached an amicable resolution in which the City of Hialeah |
|
21
|
agreed to a settlement of $400,000, and |
|
22
|
WHEREAS, the city has paid $200,000 to the claimant, |
|
23
|
leaving an unpaid settlement amount of $200,000, NOW, THEREFORE, |
|

|
|

|
Be It Enacted by the Legislature of the State of Florida: |
|

|
Section 1. The facts stated in the preamble to this act |
|
28
|
are found and declared to be true. |
|
29
|
Section 2. The City of Hialeah is authorized and directed |
|
30
|
to appropriate from funds of the city not otherwise appropriated |
|
31
|
and to draw a warrant in the amount of $200,000, payable to |
|
32
|
Asbel Llerena, husband of Maria de Jesus Llerena, as |
|
33
|
compensation for personal injuries and the death of Maria de |
|
34
|
Jesus Llerena due to the negligence of an employee of the City |
|
35
|
of Hialeah. |

|
Section 3. This act shall take effect upon becoming a law. |
