Representative Bucher offered the following: |

Remove line(s) 1149, and insert:
|
|

|
of the number of claimants or defendants involved in the action; |
|

|
however, this section shall not limit noneconomic damages |
|
18
|
recoverable from any person who has been found to have committed |
|
19
|
two or more incidents of medical malpractice. For purposes of |
|
20
|
this section:
|
|

|
(1) "Medical malpractice" means both the failure to |
|
22
|
practice medicine in this state with the level of care, skill, |
|
23
|
and treatment recognized in general law related to health care |
|
24
|
providers' licensure, and any similar wrongful act, neglect, or |
|
25
|
default in any other state or country which, if committed in |
|
26
|
this state, would be considered medical malpractice.
|
|
27
|
(2) "Found to have committed" means that the malpractice |
|
28
|
has been found in a final judgment of a court of law, final |
|
29
|
administrative agency decision, or decision of binding |
|
30
|
arbitration or similar process which is entered or enforceable |
|
31
|
in a court of law.
