  1                      A bill to be entitled

  2         An act relating to state planning and

  3         budgeting; amending s. 216.023, F.S.; requiring

  4         a summary of each state agency and the judicial

  5         branch of state government's preceding year's

  6         financial data to be submitted annually to the

  7         Legislature; providing content requirements of

  8         the summary; providing an effective date.

  9

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsections (4) and (5) of section 216.023,

13  Florida Statutes, are amended to read:

14         216.023  Legislative budget requests to be furnished to

15  Legislature by agencies.--

16         (4)  The legislative budget request must contain for

17  each program:

18         (a)  The constitutional or statutory authority for a

19  program, a brief purpose statement, and approved program

20  components.

21         (b)  Information on expenditures for 3 fiscal years

22  (actual prior-year expenditures, current-year estimated

23  expenditures, and agency budget requested expenditures for the

24  next fiscal year) by appropriation category.

25         (c)  Details on trust funds and fees.

26         (d)  The total number of positions (authorized, fixed,

27  and requested).

28         (e)  An issue narrative describing and justifying

29  changes in amounts and positions requested for current and

30  proposed programs for the next fiscal year.

31         (f)  Information resource requests.

  1         (g)  Legislatively approved output and outcome

  2  performance measures and any proposed revisions to measures.

  3         (h)  Proposed performance standards for each

  4  performance measure and justification for the standards and

  5  the sources of data to be used for measurement.

  6         (i)  Prior-year performance data on approved

  7  performance measures and an explanation of deviation from

  8  expected performance. Performance data must be assessed for

  9  reliability in accordance with s. 20.055.

10         (j)  Unit costs for major activities for the budget

11  entities as defined in the General Appropriations Act. It is

12  the intent of the Legislature that total accountability

13  measures, including to use unit-cost data, serve not only as a

14  budgeting tool but also as a policymaking tool and an

15  accountability tool. Therefore, each state agency and the

16  judicial branch budget entity must also submit a one-page

17  summary of information for the preceding year in accordance

18  with the legislative budget instructions. Each one-page

19  summary must contain related to itself, subordinate entities,

20  and contracting entities which includes:

21         1.  The final budget for the agency and the judicial

22  branch each entity;

23         2.  Total funds from the General Appropriations Act;

24         3.  Adjustments to the General Appropriations Act;

25         2.  The total amount of revenue received or otherwise

26  passed through each entity;

27         4.3.  The line-item listings of all major activities

28  along with total amounts spent for each major activity and

29  unit costs for each such activity; and

30         5.  The number of activity units performed or

31  accomplished;

  1         6.  Total expenditures for each activity including

  2  amounts paid to contractors and subordinate entities.

  3  Expenditures related to administrative activities not aligned

  4  with output measures must consistently be allocated to

  5  activities with output measures prior to computing unit costs;

  6         7.  The cost per unit for each activity, including the

  7  costs allocated to contractors and subordinate entities; and

  8         8.4.  The total amount of reversions and pass-through

  9  expenditures omitted from or actual pass-throughs without

10  unit-cost calculations data.

12  At the regular session immediately following the submission of

13  the agency unit cost summary, the Legislature shall reduce in

14  the General Appropriations Act for the ensuing fiscal year, by

15  an amount equal to at least 10 percent of the allocation for

16  the fiscal year preceding the current fiscal year, the funding

17  of each state agency that fails to submit the report required

18  under this paragraph.

19         9.(k)  Proposed performance incentives and

20  disincentives.

21         (5)  At the time specified in the legislative budget

22  instructions and in sufficient time to be included in the

23  Governor's recommended budget, Prior to September 15 of the

24  fiscal year prior to which the judicial branch is required to

25  submit a performance-based program budget request, the Chief

26  Justice of the Supreme Court shall identify and, after

27  consultation with the Office of Program Policy Analysis and

28  Government Accountability, submit to the President of the

29  Senate and the Speaker of the House of Representatives a list

30  of proposed programs and associated performance measures. The

31  judicial branch shall provide documentation to accompany the

  1  list of proposed programs and performance measures as provided

  2  under subsection (4). The judicial branch shall submit a

  3  performance-based program agency budget request using the

  4  programs and performance measures adopted by the Legislature.

  5  The Chief Justice may propose revisions to approved programs

  6  or performance measures for the judicial branch. The

  7  Legislature shall have final approval of all programs and

  8  associated performance measures and standards for the judicial

  9  branch through the General Appropriations Act or legislation

10  implementing the General Appropriations Act. By September 15,

11  2001, the Chief Justice of the Supreme Court shall submit to

12  the President of the Senate and the Speaker of the House of

13  Representatives a performance-based program budget request for

14  programs of the judicial branch approved by the Legislature

15  and provide a copy to the Executive Office of the Governor.

16         Section 2.  This act shall take effect July 1, 2003.
