Between lines 50 and 51, insert: |

Section 3. Security plans for sources of potable water and |
|
18
|
potable water treatment facilities owned or operated by or under |
|
19
|
contract to a regional water supply authority, county, special |
|
20
|
district, or municipality are exempt from the requirements of s. |
|
21
|
119.07(1), Florida Statutes, and s. 24(a), Article I of the |
|
22
|
State Constitution. Materials that depict critical operating and |
|
23
|
distribution facilities are also exempt if the regional water |
|
24
|
supply authority, county, special district, or municipality |
|
25
|
determines that the materials contain information that is not |
|
26
|
generally known and that could jeopardize the public health, |
|
27
|
safety, and welfare. Such materials include, but are not limited |
|
28
|
to, information on chemical purchases and storage, power |
|
29
|
generation systems, facility operations manuals, design |
|
30
|
information, and security systems, plans, and maps. This section |
|
31
|
is subject to the Open Government Sunset Review Act of 1995 in |
|
32
|
accordance with s. 119.15, Florida Statutes, and shall stand |
|
33
|
repealed on October 2, 2008, unless reviewed and saved from |
|
34
|
repeal through reenactment by the Legislature. |
|
35
|
Section 4. The Legislature finds that the exemption from |
|
36
|
public records requirements for security plans for sources of |
|
37
|
potable water and potable water treatment facilities owned or |
|
38
|
operated by or under contract to a regional water supply |
|
39
|
authority, county, special district, or municipality
|
|
40
|
provided by this act are necessary to ensure the security of |
|
41
|
potable water sources and potable water treatment facilities |
|
42
|
that are critical to the public health, safety, and welfare and |
|
43
|
that are potential targets for terrorist activities.
