11          An act relating to the Chief of Domestic Security
12    Initiatives; amending s. 943.0311, F.S.; requiring the
13    chief to conduct security assessments of buildings,
14    facilities, and structures owned or leased by state
15    agencies, state universities, and community colleges
16    utilizing the personnel and resources of the state agency,
17    state university, or community college that owns or leases
18    the building, facility, or structure undergoing the
19    security assessment; requiring cooperation with the
20    Department of Law Enforcement and the chief; requiring the
21    chief to report failure to provide such cooperation;
22    requiring completion of initial assessments of all
23    buildings, facilities, and structures owned or leased by a
24    state agency, state university, or community college by a
25    specified date; providing for subsequent security
26    assessments; revising reporting requirements; requiring
27    the chief to promote the importance of security
28    assessments of public buildings, facilities, and
29    structures to local governments; providing that costs of
30    security assessments of local government buildings,
31    facilities, and structures shall be borne by the local
32    government; providing an effective date.
33         
34          Be It Enacted by the Legislature of the State of Florida:
35         
36          Section 1. Section 943.0311, Florida Statutes, is amended
37    to read:
38          943.0311 Chief of Domestic Security Initiatives;and the
39    department's duties of the departmentwith respect to domestic
40    security.--
41          (1)The executive director of the department, or a member
42    of the department designated by the executive director, shall
43    serve as the Chief of Domestic Security Initiatives.
44          (1)The Chief of Domestic Security Initiatives shall:
45          (a) Coordinate the efforts of the department in the
46    ongoing assessment of this state's vulnerability to, and ability
47    to detect and respond to, acts of terrorism, as defined in s.
48    775.30,within or affecting this state.
49          (b) Prepare recommendations for the Executive Office of
50    theGovernor, the President of the Senate, and the Speaker of
51    the House of Representatives which are based upon ongoing
52    assessments to limit the vulnerability of the state to
53    terrorism.
54          (c) Coordinate the collection of proposals to limit the
55    vulnerability of the state to terrorism.
56          (d) Use regional task forces to support the duties of the
57    department set forth in this section.
58          (e) Use public or private resources to perform the duties
59    assigned to the department under this section.
60          (f) Perform other duties assigned by law.
61          (2)(a) The chief shall conduct specificsecurity
62    assessments of buildings,and facilities, and structuresowned
63    or leased by state agencies, state universities, and community
64    collegesor local governments. Such security assessments shall
65    be conducted by the personnel and with the resources of the
66    state agency, state university, or community college that owns
67    or leases the building, facility, or structure undergoing the
68    security assessment. EveryAll state agency, state university,
69    and community collegeagencies and local governmentsshall
70    cooperate with the department and shall provide the assistance
71    of employees within existing resources toand provide to the
72    chief requested information in the format requested by the chief
73    and resources to assist the department in meeting its
74    responsibilities under this section. The chief shall report to
75    the Governor, the President of the Senate, and the Speaker of
76    the House of Representatives should any state agency, state
77    university, or community college substantially fail to cooperate
78    in making a security assessment of the buildings, facilities,
79    and structures of the state agency, state university, or
80    community college.
81          (a) The initial assessment of each building, facility, or
82    structure owned or leased by a state agency, state university,
83    or community college shall be completed by each state agency,
84    state university, and community college, and shall be provided
85    to the chief no later than December 1, 2003.
86          (b) The chief may request followup assessments to ensure
87    that the security assessments of buildings, facilities, and
88    structures owned or leased by state agencies, state
89    universities, and community colleges remain reasonably current
90    and valid.
91          (b) Based upon the security assessments, the chief shall
92    prepare recommendations to enhance the security of buildings and
93    facilities owned or leased by state agencies or local
94    governments.
95          (3)(c) The chief shall report to the Executive Office of
96    theGovernor, the President of the Senate, and the Speaker of
97    the House of Representatives:
98          (a) By November 1 of each year, prioritized suggestions
99    for specific security enhancements ofrecommended minimum
100    security standards or security-enhancement needs forany
101    building,or facility, or structureowned or leased by a state
102    agency, state university, or community collegeor local
103    government. The report must identify and prioritize the
104    recommended security enhancements and provide recommendations to
105    maximize federal funding in support of building and facility
106    security.
107          (b)(3) The chief shall develop and submit to the Executive
108    Office of the Governor, the President of the Senate, and the
109    Speaker of the House of RepresentativesRecommended best
110    practices for safety and security of buildings, facilities, and
111    structures owned or leased by state agencies, state
112    universities, community colleges, and local governments. To
113    promote the continued safety of government buildings,
114    facilities, and structures within the state, the best practices
115    may be revised or enhanced by the chief as necessary. The
116    recommended best practices are not a rule as defined in chapter
117    120. The chief shall review the recommended best practices as
118    necessary, but at least once each year, and shall submit any
119    recommended changes to the Executive Office of the Governor, the
120    President of the Senate, and the Speaker of the House of
121    Representatives.
122          (4) The chief shall communicate to local governments the
123    importance of conducting security assessments of buildings,
124    facilities, and structures owned or leased by such local
125    governments and the options local governments should consider in
126    obtaining security assessments. The cost of any security
127    assessment of a building, facility, or structure owned or leased
128    by a local government shall be borne by the local governmentmay
129    conduct specific security assessments of a building or facility
130    owned by a private entity upon the request of that private
131    entity. The chief may prioritize requests, and such
132    prioritization is not agency action that is subject to review
133    under chapter 120. The chief may solicit private entities for
134    the purpose of receiving requests to perform security
135    assessments of buildings or facilities. Private entities are
136    urged to cooperate with and assist the department in meeting its
137    responsibilities for domestic security.
138          (5) By November 1 of each year, the executive director
139    shall compile, coordinate, and prioritize recommendations and
140    proposals concerning security and shall present the
141    recommendations and proposals to the Executive Office of the
142    Governor, the President of the Senate, and the Speaker of the
143    House of Representatives. All recommendations seeking funding
144    shall be prioritized, with critical domestic security needs
145    requiring immediate or top-priority funding being clearly
146    identified. Such recommendations shall include recommendations
147    to maximize federal funding in support of the state's domestic-
148    security efforts.
149          Section 2. This act shall take effect upon becoming a law,
150    or July 1, 2003, whichever occurs first.
