16          pursuant to paragraph (c) is a residenttri-county rail.
17          (3)(a) Members of the governing board of the authority
18    shall serve 4-year staggered terms, except that the terms of the
19    appointees of the Governor shall be concurrent.
20          (b) The terms of the board members currently serving on
21    the authority that is being succeeded by this act shall expire
22    July 30, 2003, at which time the terms of the members appointed
23    pursuant to subsection (2) shall commence. The Governor shall
24    make his or her appointments to the board within 30 days after
25    July 30, 2003.The terms of the county commissioners on the
26    governing board of the authority shall be 2 years. All other
27    members on the governing board of the authority shall serve
28    staggered 4-year terms. Each member shall hold office until his
29    or her successor has been appointed.
30          (4) A vacancy during a term shall be filled by the
31    respective appointing authority in the same manner as the
32    original appointment and only for the balance of the unexpired
33    term.
34          (5) The members of the authority shall serve withoutnot
35    be entitled to compensation, but are entitled to reimbursement
36    shall be reimbursedfor travel expenses actually incurred in
37    their duties as provided by law.
38          Section 4. Section 343.54, Florida Statutes, is amended to
39    read:
40          343.54 Powers and duties.--
41          (1)(a) The authority created and established by this part
42    shall have the right to own, operate, maintain, and manage a
43    transitcommuter rail system in the tri-county area of Broward,
44    Miami-DadeDade, and Palm Beach Counties, hereinafter referred
45    to as the South Florida Regional Transportation AuthorityTri-
46    County Rail.
47          (b) It is the express intention of this part that the
48    authority be authorized to plan, develop, own, purchase, lease,
49    or otherwise acquire, demolish, construct, improve, relocate,
50    equip, repair, maintain, operate, and manage a transitcommuter
51    rail system and transitcommuter railfacilities; to establish
52    and determine thesuch policies as may benecessary for the best
53    interest of the operation and promotion of a transitcommuter
54    rail system; and to adopt such rules as may benecessary to
55    govern the operation of a transitcommuter rail system and
56    transitcommuter rail facilities. It is the intent of the
57    Legislature that the South Florida Regional Transportation
58    Authority shall have the overall authority to coordinate,
59    develop, and operate a regional transportation system within the
60    area served.
61          (c) Notwithstanding subsection (3), the South Florida
62    Regional Transportation Authority may not exercise the powers in
63    paragraph (b) in regard to an existing system for transporting
64    people and goods by any means owned by another entity without
65    the consent of such entity. Furthermore, if the authority
66    acquires, purchases, operates, condemns, or inherits an existing
67    entity, it shall also inherit and assume all rights, assets,
68    labor agreements, appropriations, privileges, and obligations of
69    the existing entity. This paragraph does not preclude the South
70    Florida Regional Transportation Authority from having the
71    primary responsibility to develop and coordinate transportation
72    systems within the South Florida Regional Transportation
73    Authority service area.
74          (2) The authority created in this parthereinshall be the
75    successor and assignee of the Tri-County Commuter Rail Authority
76    Organization (TCRO) and shall inherit all rights, assets, labor
77    agreements, appropriations, privileges, and obligations of the
78    Tri-County Commuter Rail AuthorityTCRO.
