14 Between lines 4837 and 4838,

16 insert:
17 Section 33. Subsections (4) and (6) of section
18 627.091, Florida Statutes, are amended to read:
19 627.091 Rate filings; workers' compensation and
20 employer's liability insurances.--
21 (4) An insurer may not satisfy its obligation to make
22 such filings by becoming a member of, or a subscriber to, a
23 licensed rating organization or which makes such filings and
24 by authorizing such organization to make, and the department
25 to accept, such filings in its behalf; and but nothing
26 contained in this chapter shall be construed as requiring any
27 insurer to become a member or a subscriber to any rating
28 organization.
29 (6) Notwithstanding the provisions of subsection (4),
30 whenever the committee of a recognized rating organization
31 with responsibility for workers' compensation and employer's

1 liability insurance rates in this state meets to discuss the
2 necessity for, or a request for, Florida worker's compensation
3 and employer's disability insurance rate increases or
4 decreases, the determination of Florida rates, the rates to be
5 requested, and any other matters pertaining specifically and
6 directly to such Florida rates, such meetings shall be held in
7 this state and shall be subject to s. 286.011. The committee
8 of such a rating organization shall provide at least 3 weeks'
9 prior notice of such meetings to the department and shall
10 provide at least 14 days' prior notice of such meetings to the
11 public by publication in the Florida Administrative Weekly.
