Section 1. Subsection (4) of section 465.0265, Florida |
|

Statutes, is renumbered as subsection (5) and a new subsection |
|

|
(4) is added to said section, to read: |
|

465.0265 Centralized prescription filling.-- |
|
20
|
(4) Pharmacies accessing the same prescription records in |
|
21
|
a centralized database or pharmacy computers linked in any other |
|
22
|
manner may refill or dispense prescriptions at the request of |
|
23
|
another pharmacy so linked, provided that the pharmacies have |
|
24
|
the same owner or have a written contract specifying the |
|
25
|
services to be provided by each pharmacy, the responsibilities |
|
26
|
of each pharmacy, and the manner in which the pharmacies will |
|
27
|
comply with federal and state laws, rules, and regulations. |
|
28
|
Prescriptions refilled or dispensed using such a system shall |
|
29
|
not be considered prescription transfers or copies provided the |
|
30
|
computer system registers a complete and full audit trail of all |
|
31
|
activities and includes the identification of the pharmacies and |
|
32
|
pharmacists accessing the centralized database, and provided |
|
33
|
that the system restricts access to the computerized |
|
34
|
prescription records to pharmacies or other authorized |
|
35
|
personnel.
