  1                      A bill to be entitled

  2         An act relating to determination of resident

  3         status for tuition purposes; amending s.

  4         1009.21, F.S.; classifying specified students

  5         as residents for tuition purposes; providing an

  6         effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Paragraph (k) is added to subsection (10)

11  of section 1009.21, Florida Statutes, to read:

12         1009.21  Determination of resident status for tuition

13  purposes.--Students shall be classified as residents or

14  nonresidents for the purpose of assessing tuition in community

15  colleges and state universities.

16         (10)  The following persons shall be classified as

17  residents for tuition purposes:

18         (k)  Students who meet the following requirements:

19         1.  Have resided in Florida for at least 3 consecutive

20  years immediately preceding the date the student received a

21  high school diploma or its equivalent and have attended a

22  Florida high school for at least 3 consecutive school years

23  during such time.

24         2.  Have provided to a community college or a state

25  university an affidavit stating that the student will file an

26  application to become a permanent resident of the United

27  States at the earliest opportunity he or she is eligible to do

28  so.

29         Section 2.  This act shall take effect July 1, 2003.
