11  Senator Argenziano moved the following amendment to amendment

14         Senate Amendment (with title amendment) 
15         On page 15, between lines 12 and 13,
16  
17  insert:  
18         Section 10.  Subsection (7) of section 713.02, Florida
19  Statutes, is amended to read:
20         713.02  Types of lienors and exemptions.--
21         (7)  Notwithstanding any other provision of this part,
22  no lien shall exist in favor of any contractor, subcontractor,
23  or sub-subcontractor who is unlicensed as provided in s.
24  489.128 or s. 489.532. Notwithstanding any other provision of
25  this part, if a contract is rendered unenforceable by an
26  unlicensed contractor, subcontractor, or sub-subcontractor
27  pursuant to s. 489.128 or s. 489.532, such unenforceability
28  shall not affect the rights of any other parties to enforce
29  contract, lien, or bond remedies and shall not affect the
30  obligations of a subcontractor. It shall not be a defense to
31  any claim on a bond or indemnity agreement that the principal

 1  or indemnitor is unlicensed as provided in s. 489.128 or s.

 5  which she or he is doing business.
