14 On page 45, between lines 12 and 13,
15
16 insert:
17 Section 11. Section 316.570, Florida Statutes, is
18 created to read:
19 316.570 Rebuilt, modified, or retrofitted dump
20 trucks.--
21 (1) As used in this section, the term:
22 (a) "Dump truck" means any straight truck with a net
23 weight of more than 5,000 pounds which is registered on the
24 basis of gross vehicle weight in accordance with s. 320.08(4)
25 and which is equipped with a cargo carrying body designed to
26 pivot upward to empty the load.
27 (b) "Person" means any form of corporation, limited
28 liability company, partnership, association, cooperative,
29 joint venture, business trust, sole proprietorship, or
30 self-employed person who conducts business in this state.
31 (2) Any person engaged in retrofitting, rebuilding, or

1 modifying commercial trucks, truck tractors, or heavy trucks,
2 as defined in s. 320.01, into dump trucks must have evidence
3 that he or she is insured under a garage liability insurance
4 policy that includes, at a minimum, $1 million combined
5 single-limit liability coverage, including bodily injury and
6 property damage protection. Evidence of such insurance policy
7 must be available at all reasonable hours for inspection by
8 any law enforcement officer.
9 (3) Any person engaged in retrofitting, rebuilding, or
10 modifying commercial trucks, truck tractors, or heavy trucks,
11 as defined in s. 320.01, into dump trucks must ensure that
12 such retrofitted, rebuilt, or modified dump trucks comply with
13 all federal safety standards provided in 49 C.F.R. s. 393.
14 (4) Any person who violates subsection (2) or
15 subsection (3) commits a misdemeanor of the second degree,
16 punishable as provided in s. 775.082 or s. 775.083. Any person
17 who violates subsection (2) or subsection (3) a second time
18 commits a misdemeanor of the first degree, punishable as
19 provided in s. 775.082 or s. 775.083. Any person who violates
20 subsection (2) or subsection (3) a third or subsequent time
21 commits a felony of the third degree, punishable as provided
22 in s. 775.082, s. 775.083, or s. 775.084.
