|

Be It Enacted by the Legislature of the State of Florida: |
|

|
|
|

Section 1. Subsection (1) of section 373.219, Florida |
|
11
|
Statutes, is amended to read: |
|

|
373.219 Permits required.-- |
|
13
|
(1) The governing board or the department may require such |
|
14
|
permits for consumptive use of water and may impose such |
|
15
|
reasonable conditions as are necessary to assure that such use |
|
16
|
is consistent with the overall objectives of the district or |
|
17
|
department and is not harmful to the water resources of the |
|
18
|
area.These permits shall not be issued until affected local |
|
19
|
governments have been given due notice of the proposed |
|
20
|
consumptive use permit and an opportunity to file objections to |
|
21
|
the issuance of the proposed permit with the governing board. |
|
22
|
However, no permit shall be required for domestic consumption of |
|
23
|
water by individual users. |
|

Section 2. Subsection (1) of section 373.223, Florida |
|
25
|
Statutes, is amended to read: |
|

|
373.223 Conditions for a permit.-- |
|
27
|
(1) To obtain a permit pursuant to the provisions of this |
|
28
|
chapter, the applicant must establish that the proposed use of |
|
29
|
water: |
|
30
|
(a) Is a reasonable-beneficial use as defined in s. |
|
31
|
373.019; |
|
32
|
(b) Will not interfere with any presently existing legal |
|
33
|
use of water;and |
|
34
|
(c) Is consistent with the public interest; and |
|
35
|
(d) Is consistent with the affected local government's |
|
36
|
comprehensive plan and that the applicant has obtained all of |
|
37
|
the necessary land use and zoning permits. |
|

|
Section 3. This act shall take effect upon becoming a law. |
|

|
|
