| 11 | An act relating to specialty license plates; creating s. | ||
| 12 | 320.08068, F.S.; creating a specialty license plate for | ||
| 13 | motorcycles; providing for the distribution of annual use | ||
| 14 | fees received from the sale of such plates; providing an | ||
| 15 | effective date. | ||

| 17 | Be It Enacted by the Legislature of the State of Florida: | ||
| 18 | |||
| 19 | Section 1. Section 320.08068, Florida Statutes, is created | ||
| 20 | to read: | ||
| 21 | 320.08068 Motorcycle specialty license plates.-- | ||
| 22 | (1) Notwithstanding the provisions of s. 320.08053, the | ||
| 23 | department shall develop a reduced dimensions specialty license | ||
| 24 | plate for display on motorcycles. | ||
| 25 | (2) The department shall issue a specialty license plate | ||
| 26 | to the owner or lessee of any motorcycle upon request and | ||
| 27 | payment of the appropriate license taxes and fees. | ||
| 28 | (3) Each request must be made annually to the department, | ||
| 29 | accompanied by the following taxes and fees: | ||
| 30 | (a) The license tax required under s. 320.08. | ||
| 31 | (b) A license plate fee as required by s. 320.06(1)(b). | ||
| 32 | (c) A processing fee of $2. | ||
| 33 | (d) A license plate annual use fee as required in | ||
| 34 | subsection (4). | ||
| 35 | (4) A license plate annual use fee of $15 shall be | ||
| 36 | collected for each motorcycle specialty license plate. Annual | ||
| 37 | use fees shall be distributed to The Able Trust as custodial | ||
| 38 | agent. The Able Trust may retain a maximum of 10 percent of the | ||
| 39 | proceeds from the sale of the license plate for administrative | ||
| 40 | costs. The Able Trust shall distribute the remaining funds as | ||
| 41 | follows: | ||
| 42 | (a) Twenty-five percent to the Brain and Spinal Cord | ||
| 43 | Injury Program Trust Fund. | ||
| 44 | (b) Twenty-five percent to Prevent Blindness Florida. | ||
| 45 | (c) Twenty-five percent to the Foundation for Vocational | ||
| 46 | Rehabilitation to support the personal care attendant pilot | ||
| 47 | program pursuant to section 413.402. | ||
| 48 | (d) Twenty-five percent to the Florida Association of | ||
| 49 | Centers for Independent Living in the form of matching grants | ||
| 50 | from private, nongovernmental sources. Funds distributed to the | ||
| 51 | Florida Association of Centers for Independent Living must be | ||
| 52 | used for programs and activities serving disabled Floridians. | ||
| 53 | (5) If an owner or lessee to whom the department has | ||
| 54 | issued a motorcycle specialty license plate acquires a | ||
| 55 | replacement vehicle within the owner's registration period, the | ||
| 56 | department must authorize a transfer of the specialty license | ||
| 57 | plate to the replacement vehicle in accordance with s. 320.0609. | ||
| 58 | The annual use fee or processing fee may not be refunded. | ||
| 59 | (6) The license plate shall be 4 inches wide by 7 inches | ||
| 60 | long and incorporate a red, white, and blue color scheme | ||
| 61 | approved by the department and may bear the imprint of numerals | ||
| 62 | from 1 to 999, inclusive, capital letters "A" through "Z," or a | ||
| 63 | combination thereof. The department shall determine the maximum | ||
| 64 | number of characters, including numerals and letters. Motorcycle | ||
| 65 | specialty license plates must be otherwise of the same material | ||
| 66 | as standard license plates issued for any registration period. | ||
| 67 | In small letters, the word "Florida" must appear at the top of | ||
| 68 | the plate. | ||
| 69 | (7) The department may issue personalized prestige plates | ||
| 70 | for license plates authorized in this section. Such plates shall | ||
| 71 | be issued in accordance with applicable provisions contained in | ||
| 72 | s. 320.0805. | ||
| 73 | Section 2. This act shall take effect October 1, 2003. | ||
