Section 1. Subsections (1) and (4) of section 943.10, |
|
18
|
Florida Statutes, are amended to read: |
|
19
|
943.10 Definitions; ss. 943.085-943.255.--The following |
|
20
|
words and phrases as used in ss. 943.085-943.255 are defined as |
|
21
|
follows: |
|
22
|
(1) "Law enforcement officer" means any person who is |
|
23
|
elected, appointed, or employed full time by any municipality or |
|
24
|
the state or any political subdivision thereof or who is a |
|
25
|
special railroad officer appointed pursuant to chapter 354; who |
|
26
|
is vested with authority to bear arms and make arrests; and |
|
27
|
whose primary responsibility is the prevention and detection of |
|
28
|
crime or the enforcement of the penal, criminal, traffic, or |
|
29
|
highway laws of the state. This definition includes all |
|
30
|
certified supervisory and command personnel whose duties |
|
31
|
include, in whole or in part, the supervision, training, |
|
32
|
guidance, and management responsibilities of full-time law |
|
33
|
enforcement officers, part-time law enforcement officers, or |
|
34
|
auxiliary law enforcement officers but does not include support |
|
35
|
personnel employed by the employing agency. |
|
36
|
(4) "Employing agency" means any agency or unit of |
|
37
|
government or any municipality or the state or any political |
|
38
|
subdivision thereof, or any agent thereof, which has |
|
39
|
constitutional or statutory authority to employ or appoint |
|
40
|
persons as officers. The term also includes any private entity |
|
41
|
which has contracted with the state or county for the operation |
|
42
|
and maintenance of a nonjuvenile detention facility and any |
|
43
|
private entity employing a special railroad officer pursuant to |
|
44
|
s. 354.01. |
|

|
Section 2. Subsection (3) of section 943.12, Florida |
|
46
|
Statutes, is amended to read: |
|
47
|
943.12 Powers, duties, and functions of the commission.-- |
|
48
|
The commission shall: |
|
49
|
(3) Certify, and revoke the certification of, officers, |
|
50
|
instructors, including agency inservice training instructors and |
|
51
|
special railroad officers pursuant to s. 354.01,and criminal |
|
52
|
justice training schools. |
