1 A bill to be entitled
2          An act relating to price regulation of local exchange
3    telecommunications companies; amending s. 364.051, F.S.;
4    changing the timeframe for notice of rate changes;
5    providing an effective date.

7          Be It Enacted by the Legislature of the State of Florida:
8         
9          Section 1. Paragraph (a) of subsection (5) of section
10    364.051, Florida Statutes, is amended to read:
11          364.051 Price regulation.--
12          (5) NONBASIC SERVICES.--Price regulation of nonbasic
13    services shall consist of the following:
14          (a) Each company subject to this section shall maintain
15    tariffs with the commission containing the terms, conditions,
16    and rates for each of its nonbasic services, and may set or
17    change, on715days' notice, the rate for each of its nonbasic
18    services, except that a price increase for any nonbasic service
19    category shall not exceed 6 percent within a 12-month period
20    until there is another provider providing local
21    telecommunications service in an exchange area at which time the
22    price for any nonbasic service category may be increased in an
23    amount not to exceed 20 percent within a 12-month period, and
24    the rate shall be presumptively valid. However, for purposes of
25    this subsection, the prices of:
26          1. A voice-grade, flat-rate, multi-line business local
27    exchange service, including multiple individual lines, centrex
28    lines, private branch exchange trunks, and any associated
29    hunting services, that provides dial tone and local usage
30    necessary to place a call within a local exchange calling area;
31    and
32          2. Telecommunications services provided under contract
33    service arrangements to the SUNCOM Network, as defined in
34    chapter 282,

36          shall be capped at the rates in effect on July 1, 1995, and such
37    rates shall not be increased prior to January 1, 2000; provided,
38    however, that a petition to increase such rates may be filed
39    pursuant to subsection (4) utilizing the standards set forth
40    therein. There shall be a flat-rate pricing option for multi-
41    line business local exchange service, and mandatory measured
42    service for multi-line business local exchange service shall not
43    be imposed. Nothing contained in this section shall prevent the
44    local exchange telecommunications company from meeting offerings
45    by any competitive provider of the same, or functionally
46    equivalent, nonbasic services in a specific geographic market or
47    to a specific customer by deaveraging the price of any nonbasic
48    service, packaging nonbasic services together or with basic
49    services, using volume discounts and term discounts, and
50    offering individual contracts. However, the local exchange
51    telecommunications company shall not engage in any
52    anticompetitive act or practice, nor unreasonably discriminate
53    among similarly situated customers.
54          Section 2. This act shall take effect upon becoming a law.
