13 Senate Amendment (with title amendment)
14 On page 73, between lines 29 and 30,

16 insert:
17 Section 33. Present subsection (4) of section 408.036,
18 Florida Statutes, is redesignated as subsection (5) and a new
19 subsection (4) is added to that section, to read:
20 408.036 Projects subject to review; exemptions.--
21 (4) For requests for an exemption to establish an
22 open-heart-surgery program, in addition to any other
23 documentation otherwise required by the agency, the request
24 must include a certification that the applicant will not apply
25 for a certificate of need for the establishment of an
26 open-heart-surgery program pursuant to subsection (1) or
27 subsection (2) and it will not initiate or intervene in an
28 administrative hearing related to the establishment of an
29 adult open-heart-surgery program at another hospital pursuant
30 to s. 408.039(5).
